1. General provisions

1.1. This document (the “Terms and Conditions”) governs the relationship between eJobs Group S.R.L., a limited liability company with its registered office at Bd. Dimitrie Pompeiu, No. 9–9A, District 2, Bucharest, Romania, registered with the Trade Register under No. J2005008378401, tax identification number 17562631 (the “Company” or “We”), and persons who use, for any purpose (the “User”), the website www.eJobs.ro (the “eJobs Website”) and/or the equivalent eJobs.ro – Locuri de Muncă application, which can run on a mobile computing device, such as a smartphone and/or tablet, and is available in mobile application stores (such as Google Play or the App Store) (the “eJobs App”), collectively referred to as the “Platform”/“eJobs Platform”, as well as the services provided by the Company through them (the “Services”).

1.2. Access to and use of the Platform, including any of its pages and/or sections and/or any Service provided through the Platform, is permitted only in accordance with this document.

1.3. WHEN REGISTERING AND CREATING A USER ACCOUNT TO USE THE SERVICES, OR AT OTHER TIMES WHEN NECESSARY, WE WILL ASK THE USER TO AGREE TO THESE TERMS AND CONDITIONS BY TAKING A SPECIFIC, UNAMBIGUOUS ACTION SIGNIFYING CONSENT.

BY TAKING THAT SPECIFIC ACTION, THE USER:

A. ACCEPTS THESE TERMS AND CONDITIONS AND EXPRESSLY AGREES TO COMPLY WITH ALL THE PROVISIONS OF THESE TERMS AND CONDITIONS, AS WELL AS ANY OTHER SPECIFIC TERMS AND CONDITIONS APPLICABLE TO THE SERVICES; when registering an Employer Account, creating the account also entails making the declaration of authority to represent the Client under Section 5.2.2.

B. CONFIRMS THAT THEY HAVE READ AND UNDERSTOOD THE CONDITIONS GOVERNING THE PROCESSING OF PERSONAL DATA IN ACCORDANCE WITH THE PRIVACY POLICY PUBLISHED BY THE COMPANY.

To ensure compliance with the conditions for accessing and using the Services, all Users must review the Terms and Conditions of use each time they access the Platform.

Even if you fail to review the Terms and Conditions but use the Platform in any manner, we will consider that you have accepted these Terms and Conditions (including any updates), unless, exclusively during the relevant period, your use is governed by specific rules expressly communicated to you (e.g. use during the notice period preceding the entry into force of updates, where applicable).

If you do not agree with the provisions of these Terms and Conditions (including any updates), please refrain from using or, as applicable, cease using the Platform and/or the Services We provide.

3.1. These Terms and Conditions set out the conditions for accessing and using the Platform and the Services, the rights and obligations of the Company and Users and, in the case of Recruiter Users, the conditions under which the Services are provided to Clients.

3.2. The Services offered through the Platform are intended for the following categories of Users:

a) Visitors — natural persons who use the Platform without creating an account and may view its public content to the extent permitted by the functionalities available without signing in;

b) Candidate Users — natural persons who hold a Candidate Account and use the Platform to seek employment and/or manage their own career, benefiting primarily from the following Services: creating and managing a professional profile and CV, searching for and viewing job advertisements, applying for advertised jobs, and managing applications and communications with Clients.

c) Clients — legal entities, authorised sole traders or other entities wishing to publish job advertisements and/or search for Candidate Users for employment purposes, benefiting, through Recruiter Users acting in their name and on their behalf, primarily from the following Services: publishing and managing job advertisements, searching the CV database online, contacting Candidate Users for employment purposes and managing applications.

3.3. Details of the Services and specific conditions of use are set out in these Terms and Conditions. The Company may at any time develop, add, modify or discontinue any Platform functionalities, subject to these Terms and Conditions.

The Terms and Conditions are binding both on Users and Clients who create accounts after the Effective Date and on those who have an existing legal relationship with the Company on that date, subject to Section 5.3.2.

Together with their Annexes and the documents expressly incorporated by reference, the Terms and Conditions constitute the parties’ entire agreement regarding use of the Platform and provision of the Services, subject to documents separately negotiated with certain Clients, in accordance with the order of precedence in Section 5.3.1.

4. Candidate Users

4.1. Services for Candidate Users

4.1.1. The Platform enables Candidate Users to create two CVs in its database (one Romanian version and one English version) and benefit primarily from the following Services: creating and managing their Candidate Account and CVs; searching for and viewing job advertisements; applying for advertised jobs; and managing applications and communications with Clients.

4.1.2. As part of the Services, at a Candidate User’s request (by email or telephone), the Company may also provide assistance through its consultants. With the Candidate User’s express consent, an eJobs consultant may create a Candidate Account for them (if none already exists), draft their CV and, if the User wishes and expressly agrees, apply using their CV for suitable jobs presented to them individually in advance. The Candidate User may subsequently edit the information published in their account at any time.

4.1.3. The Company is not a party to the relationships established between a Candidate User and a Client (including any employment relationship) and does not guarantee employment, offers and/or responses to applications.

4.1.4. The Company imposes fairness requirements on Clients regarding the content of job advertisements, but cannot guarantee compliance by all Clients and is not obliged to check published content in advance. We recommend that you carefully assess the information in advertisements before applying, attending an interview, taking up employment or undertaking any action involving your own or third-party resources. If you identify an advertisement containing misleading or illegal content, please report it using the Illegal Content Notice form under Section 9, or contact us under Section 17.3.

4.2. Creating a Candidate Account, passwords and responsibilities

4.2.1. To benefit from all the Services, the Candidate User must create a Candidate Account on the Platform by completing the forms available in the “NEW ACCOUNT” section. An account may also be created through the User’s account on the Facebook social networking platform, in which case the Platform will retrieve certain public User data associated with their Google or Apple account.

4.2.2. The email address and telephone number provided by the Candidate User are validated by following the verification steps indicated on the Platform.

4.2.3. Candidate Users may create an account only if they are at least 16 years old when the account is created. Persons under 16 are not permitted to access the Platform or use the Services.

4.2.4. To use the Services offered by the eJobs Platform, the Candidate User must:

A. provide true, accurate and complete data by completing the fields in the registration form for the Candidate Account;

B. where necessary, update their registration data to keep it true, accurate and complete, within no more than 30 days after any changes occur.

4.2.5. The Candidate User is solely responsible for keeping their login credentials confidential and for actions performed through their account. If they suspect unauthorised access, they must immediately notify the Company at contact@ejobs.ro and change their password.

4.2.6. The Company is not obliged to check in advance the materials and information published by Users and, subject to applicable law, is not liable for information and data posted, disseminated or transmitted by them. At a User’s request or if it discovers signs of possible fraud, the Company may investigate and decide to remove that information in accordance with the law and these Terms and Conditions.

4.2.7. Account access is password-protected. To keep your account secure, we recommend that you do not disclose your password to anyone; sign out (“Deconectare” / “Log out”) at the end of each session; close your browser window when you finish browsing; and, if you use the eJobs App, also protect your mobile device against unauthorised access (e.g. by using a password/biometric screen lock). The Company will never ask for your password through unsolicited messages or calls. Any such request must be treated as attempted fraud and reported to the Company.

4.2.8. The Candidate User may stop using the Services and close their Candidate Account at any time, free of charge, through their account settings or by submitting a request under Section 17.3.

4.3. Creating a CV and applying to advertisements

4.3.1. The Candidate User may create their CV by completing the forms available on the Platform. Their CV and contact details may be made available to Clients for recruitment purposes, subject to the visibility conditions described in Section 4.3.2. The CV constitutes User-Posted Content within the meaning of Section 6, and the Candidate User is solely responsible for ensuring that the information it contains is accurate and up to date.

4.3.2. The Candidate User has the following options regarding the visibility of their CV:

a. When a Candidate Account is registered, the CV data is automatically set to public. The Candidate User may subsequently set it to confidential. Even if the CV is set to confidential, the Candidate User may apply for jobs, but the CV may only be viewed by Clients who acquired access rights while it was still public and by Clients whose advertisements the User has applied or will apply to.

b. The CV may be set to public using the “CV public for employers” option in the “My CV – CV visibility” section. This option may subsequently be changed at any time by setting the CV to confidential using the “CV hidden from employers” option in the “My CV – CV visibility” section. By setting the CV to public for employers, Clients, through Recruiter Users with access to the eJobs Platform database, will have access to the CV. They may ask us to unlock the contact details so that they can contact the Candidate User for an interview or job offer.

4.3.3. By applying to a job advertisement, the Candidate User requests that their CV and contact details be sent to the Client who published the advertisement.

4.3.4. The Candidate User may hide their CV from the database or delete their Candidate Account at any time, in which case Clients will no longer have access to their data through the Platform. However, Clients who have accessed the CV under Section 4.3.2 may download or save the information on their own storage media. In that case, even if the Company deletes the Candidate User’s data from its own database, hiding the CV or deleting the account does not affect copies already held by Clients. As independent personal data controllers, Clients are exclusively responsible for how they use data accessed through the Platform, in accordance with their own privacy policies.

4.3.5. Please note that your contact details (name, email, telephone number, address) entered on the Platform will be available to Recruiter Users and used in the recruitment process. Accordingly, as part of the application and recruitment process, the Candidate User may receive updates regarding their applications (including by email and SMS) as part of the provision of the Services. Further information about the Company’s processing of this data is provided in the Privacy Policy.

5. Recruiter Users

5.1. Services for Clients

5.1.1. Through the Platform, the Company provides its Clients with the following Services:

a) publishing and managing job advertisements on the Platform, up to the number included in our service packages available on the Platform on the order date, under Sections 5.5 and 5.6;

b) accessing and searching the CV database online, according to our service packages available on the Platform on the order date: viewing CVs for preselection purposes without disclosure of their holders’ contact details, and viewing in full (with contact details unlocked) the number of CVs included in the package/order, under Section 5.7;

c) managing applications received and communications with Candidate Users through the Platform, as part of the services under points a) and b);

d) reasonable assistance with use of the Platform and the Services, through the support channels indicated on the Platform;

e) other services agreed by the parties under Section 5.1.4.

5.1.2. As part of managing the contractual relationship, Company representatives may telephone Recruiter Users using the contact details associated with the Employer Account for purposes such as: confirming and activating the account, assisting with use of the Services, providing information about functionalities associated with the contracted Services, and handling requests and operational or commercial aspects of the relationship. The conditions governing personal data processing are detailed in our Privacy Policy.

5.1.3. The Company is not a party to the legal relationships between the Client and Candidate Users and does not guarantee any particular number of applications, candidates or hires resulting from use of the Services, unless expressly agreed otherwise.

5.1.4. By entering into separate legal instruments, including through email correspondence, the parties may agree on the provision of Services other than those set out in these Terms and Conditions, under the conditions and within the time limits agreed in those instruments. Unless the parties agree otherwise, these Terms and Conditions apply on a supplementary basis.

5.2. Creating an Employer Account, passwords and responsibilities

5.2.1. Registration process

a) An Employer Account is created by completing the registration forms available on the Platform and providing true, accurate, up-to-date and complete information in all mandatory fields.

b) By clicking the registration button, the person creating the account accepts these Terms and Conditions and declares that they have the necessary legal authority to represent and validly bind the Client under Section 5.2.2.

c) Once the contact verification procedures under Section 5.2.3 have been completed, the User is emailed the version of the Terms and Conditions and Data Processing Agreement accepted upon registration, on a durable medium.

5.2.2. Declaration of authority and Client warranties

a) By creating the Employer Account, its creator acquires the Owner Role and declares on their own responsibility that (i) they act in the name and on behalf of the Client and have the necessary legal right and authority to represent and validly bind the Client in its dealings with the Company, including by accepting these Terms and Conditions, and (ii) the Client has all the rights, authorisations and permissions necessary to assume and perform the obligations and grant the rights and authorisations provided for in these Terms and Conditions and other related documents. In the case of an authorised sole trader, the person creating the Employer Account acquires the Owner Role and declares on their own responsibility that they act in their own name in a professional capacity.

b) For Employer Accounts existing on the Effective Date of these Terms and Conditions, the Owner Role is assigned to the person who, in their dealings with the Company, performed the duties specific to that role up to the Effective Date, or to another person, where applicable. That person makes the declaration under point a) upon their first login after the Effective Date, by the method indicated by the Company on the Platform (e.g. the confirmation displayed upon login).

c) The declaration under point a) must be renewed by any person who subsequently acquires the Owner Role, upon their first login after acquiring that Role.

d) The Client warrants that all Recruiter Users are authorised to act in its name and on its behalf within the limits of their assigned Roles, and is responsible for their actions when using the Platform as if they were its own actions.

e) The Client warrants that it has taken and maintains all necessary legal measures to ensure that Recruiter Users are duly authorised to act within the limits of their assigned Roles.

5.2.3. Verification of contact details

a) After completing the registration form, the User receives a confirmation link at the email address provided. Confirmation of the email address is mandatory to continue the process.

b) The contact person’s telephone number, provided during the initial Employer Account setup under Section 5.2.5, is also subject to validation.

5.2.4. Account verification and approval

a) The Company checks the accuracy of the registered tax identification number by consulting the Ministry of Finance’s public records (www.mfinante.ro). Recruiter Users must provide genuine information regarding the Client’s identification details, email address and telephone number, and the contact person’s identification and contact details.

b) Clients must remain active for tax purposes throughout the period in which they hold an active account on the Platform (they must not be deregistered, suspended, liquidated, etc.).

c) Clients recruiting for positions abroad must send a copy of the Registration Certificate issued by the Trade Register showing personnel placement and recruitment as their business activity.

d) Clients established abroad must, when registering on the Website, enter a valid VAT number in the dedicated account creation field and send a copy of the document evidencing their tax registration in their country of residence.

e) On a sample-check basis, eJobs consultants may request documents concerning the Client’s business activity, verify whether the person who registered the account or the contact person is authorised to represent the Client, and check any other matters relevant to the accuracy of the information provided.

f) Providing untrue, inaccurate or incomplete information entitles the Company to suspend or block the account and refuse all current or future attempts to use the eJobs Platform, under Section 10 of these Terms and Conditions and within the limits of the law. In the event of incorrect information or attempted fraud (including attempts to obtain free advertisements or special offers granted in marketing campaigns), the Company may, at any time during the contractual relationship, withdraw the free benefits granted or terminate the contractual relationship, without further liability to the Client at fault, under Section 10 of these Terms and Conditions and within the limits of the law.

g) The Company is not obliged to check materials published by Users in advance and, subject to applicable law, is not liable for information and data posted, disseminated or transmitted by them. At a User’s request or if it discovers signs of possible fraud, the Company may investigate and decide to remove that information, in accordance with the law and these Terms and Conditions.

5.2.5. Initial account setup

a) After confirming their email address, the User completes a mandatory initial Employer Account setup stage, providing information needed to configure the Services and produce statistics (e.g. the position being recruited for, industry, departments), as well as the contact person’s details: surname, first name, email address, correspondence address, telephone number (validated under Section 5.2.3) and job title.

b) The contact person’s details are prefilled with those of the person who registered the account, but may be changed if the recruitment contact person differs from the account creator.

c) Full access to the Employer Account is granted after completion of the initial account setup process.

5.2.6. Passwords and responsibilities

a) The Client (including through its Recruiter Users) is solely responsible for maintaining the confidentiality of login credentials. Credentials are individual and must not be shared with anyone else, including persons within or representing the same Client. Each person using the Platform in the Client’s name and on its behalf must have their own account, under Section 5.4.

b) Any action performed through an account is presumed to have been performed by its holder in the Client’s name and on its behalf, including where credentials have been shared, leaked or used without authorisation, until the Company receives the notification under point c) below. The Company will deactivate or suspend the credentials covered by that notification within a reasonable time after receipt.

c) The Client or the Recruiter User concerned must notify the Company in writing by email, as soon as possible, of:

  • the termination of the authority or relationship between the Client and a Recruiter User, in which case the Client must immediately revoke or suspend that person’s credentials using the tools available on the Platform or, if none are available, by written request to the Platform. Where the termination concerns the person holding the Owner Role, a new Owner is appointed at the Client’s written request, in accordance with the Company’s requirements;
  • reasonable suspicions of unauthorised account use or compromised credentials.

d) The account protection recommendations in Section 4.2.7 apply accordingly to Recruiter Users.

5.3. Order of precedence of contractual documents and continuity of existing relationships

5.3.1. Order of precedence of documents

a) The relationship between the Company and the Client is governed by these Terms and Conditions in accordance with this Section.

b) Where the Company and the Client have separately negotiated and signed a contract, its provisions prevail over these Terms and Conditions in the event of a conflict. These Terms and Conditions remain applicable to all matters not covered by that separate contract, including the rules for using the Platform and the Roles and permissions of Recruiter Users.

c) Commercial terms (including, without limitation, price, duration, the number of advertisements or CVs included in the package/subscription, and payment methods) agreed in addenda, accepted orders or other written agreements, including email correspondence, concluded before or after the Effective Date remain in force and prevail over the corresponding provisions of these Terms and Conditions until they expire or are amended by agreement of the parties.

d) These Terms and Conditions supplement separate instruments concluded under Section 5.1.4.

5.3.2. Continuation of existing relationships

a) For Clients with contractual relationships with the Company on the Effective Date, these Terms and Conditions continue to have legal effect and amend the existing contractual relationships (regardless of how they arose), without constituting a novation or a new contract, and without interrupting the continuity of the Services or personal data processing.

b) A Client who does not agree to these Terms and Conditions may terminate the contractual relationship without additional cost by the Effective Date, by giving notice under Section 17.3. Termination does not affect obligations already due or services already provided.

c) For the avoidance of doubt, rights acquired and obligations assumed before the Effective Date (including active subscriptions, free benefits granted and unused service balances) remain valid and continue to be performed on the agreed terms, unless expressly provided otherwise in these Terms and Conditions or, having regard to the nature of those rights and obligations, a change is necessary to give effect to these Terms and Conditions.

5.4. Roles and permissions

5.4.1. Categories of permissions. Platform functionalities are grouped into the following categories of permissions:

a) Screening and interviews — managing the calendar and folders and assessing candidates;

b) Inventory consumption and content management — managing job advertisements and unlocking Candidate Users’ contact details;

c) Managing Colleague Groups within an Employer Account — inviting new Recruiter Users and managing their Roles;

d) Purchasing inventory — purchasing credits, subscriptions and other Services under Section 5.8.

5.4.2. Roles

a) The following Roles and associated permissions are available within the Employer Account:

  • Owner — all categories of permissions under Section 5.4.1, points a)–d). The Owner is also authorised to perform acts concerning the contractual relationship between the Client and the Company as a whole, including, without limitation: accepting the Terms and Conditions and their updates in the Client’s name and on its behalf; accepting or terminating separate instruments concluded under Section 5.1.4; requesting closure of the Employer Account and termination of the contractual relationship; receiving contractual notices sent by the Company under Section 17.3; and submitting requests to replace the Owner.
  • Admin — all categories of permissions under Section 5.4.1, points a)–d);
  • Manager — the permissions under Section 5.4.1, points a)–c), exercised within the Colleague Group to which they have been assigned. Permission to manage the Colleague Group includes inviting Users and managing lower-ranking Roles exclusively within that Group;
  • Recruiter — the permissions under Section 5.4.1, points a)–b);
  • Member — the permissions under Section 5.4.1, point a).

b) There is only one Owner Role within an Employer Account, acquired when the account is created under Section 5.2.2. Replacing the Owner (including changing the associated email address) is possible only in exceptional circumstances, at the Client’s written request, in accordance with the procedure communicated by the Company, which may include checks on the requester’s identity and capacity.

c) Other Roles are assigned by invitation from a User with permission to manage Colleague Groups. A User may assign, change or revoke only Roles ranked below their own Role.

d) Effects of Users’ acts. Acts performed by Recruiter Users, including orders and purchases made by Users holding the permission under Section 5.4.1, point d), are binding on the Client. The Client is responsible for assigning Roles consistently with the internal authorisations granted to each User.

e) The Company may change the Role system and the content of all permission categories, informing Clients, including through the Platform. Changes that restrict existing permissions or adversely affect use of the Services will be notified in advance under Section 17.1, without reducing the Services currently being provided.

f) When inviting Recruiter Users, designating a contact person or providing the Company with personal data of any other persons within its organisation, the Client must ensure that the data is disclosed lawfully, including by informing data subjects and ensuring that an appropriate legal basis exists. The Company processes these categories of personal data as a controller, in accordance with the Privacy Policy.

5.5. How to publish recruitment advertisements (jobs) on the eJobs Platform

5.5.1. Recruitment advertisements are published within the inventory available under the active package or order, by Recruiter Users holding the relevant permissions.

5.5.2. Job advertisements are displayed on the Platform for a fixed period. Depending on the advertisement purchased (or received free of charge as part of a campaign), it may be valid for 7 or 30 days, with the possibility of extension. After publication, your advertisement is emailed to all Candidate Users who match the job profile and subscribe to such notifications.

5.5.3. The job profile in an advertisement approved for publication (by clicking the publish button) may no longer be changed after the advertisement has been displayed on the Platform and/or sent to Candidate Users. Subsequent changes may be made on request with the assistance of the Client’s dedicated eJobs consultant.

5.5.4. Job advertisements are published within the limits applicable at publication, as indicated on the Platform during the advertisement creation process.

5.5.5. Publication of advertisements in certain categories is subject to additional conditions:

a) To publish a job in the MLM industry (AVON, ORIFLAME or others), a BANKING/INSURANCE ASSOCIATE job or other ASSOCIATE jobs, an order for at least one advertisement and confirmation of payment of the pro forma invoice are required.

b) For advertisements in the video chat industry or similar industries, an order for Premium and Premium Video advertisements and confirmation of payment are required. Advertisements for video chat operators or similar positions are accepted on the Platform only if posted by legal entities. Once payment confirmation has been sent, the advertisement may be published immediately.

5.5.6. All advertisements must comply with Section 6. The Company reserves the right to moderate all advertisements and apply restrictive measures under Sections 9 and 10 and within the limits of the law.

5.6. “Free advertisements” and special discounts policy

5.6.1. The Company may, at its discretion, offer free credits for publishing job advertisements on the eJobs Platform or special discounts on its products and services. Such offers are available only to new Clients registering on the eJobs Platform for the first time, who have provided correct and complete registration details and in respect of whom there is no suspicion of fraud against the system.

5.6.2. Free benefits granted upon registration (e.g. free trial services) are available only upon registration of a Client’s Employer Account. The Company reserves the right to refuse a free benefit where it identifies the Client as being the same company as one that has already received such benefits, or in other justified cases following an internal review of newly registered Clients.

5.6.3. Free advertisements may be used within 30 days of registration of the Employer Account and may be published only in the name of the Client registered on the Platform.

5.6.4. The Company may also offer free advertisements or special discounts to existing Clients as part of marketing campaigns or under separate agreements with the Client, including by email correspondence. The terms and details are communicated individually for each campaign or in the separate agreement and supplement these Terms and Conditions for the services concerned.

We also reserve the right to refuse publication of or censor, in accordance with the law and these Terms and Conditions, advertisements that are unlawful, contrary to public morals or contain obscene language. For example, we reserve the right to moderate content or apply any restrictive measures in accordance with the law and these Terms and Conditions to advertisements for video chat operators, erotic massage or similar activities.

Accordingly, you accept and agree to comply with the principle of good faith when drafting and publishing recruitment advertisements. You undertake not to publish incomplete, incorrect or discriminatory advertisements and not subsequently to make the selection of Candidate Users subject to any conditions other than those presented in the published recruitment advertisement and compliance with applicable law. You also undertake to comply with all the conditions and limitations in Section 6 of these Terms and Conditions.

If you fail to comply with these rules, you understand and agree that eJobs may restrict your access to its Services under Sections 9, 10 and 11 of these Terms and Conditions, as applicable. Where access is restricted for Recruiter Users who have accessed paid Services, they may request reimbursement of the portion of the fee corresponding to the restricted period.

5.7. Online access to and searching of the public CV database on the eJobs Platform

5.7.1. Based on the service package purchased under Section 5.8, the Client may access and search all public CVs in the Platform’s database online and view the contact details in a limited number of CVs.

5.7.2. In all cases, the Client (including its Recruiter Users) warrants that data contained in Candidate Users’ CVs will be used solely for personnel recruitment, in accordance with the law. In particular, the following are prohibited: use of data for marketing, commercial offers or other purposes unrelated to recruitment; and systematic copying, extraction or reproduction of the CV database.

5.7.3. Some candidates who have chosen to enter their CVs in the eJobs Platform database may find it easier to present a misleading, incomplete or inaccurate account, or one that is hostile towards other social groups. We recommend that you carefully assess the information in CVs before making a hire, an investment or undertaking any other action involving your own or third-party funds or resources. CVs containing illegal content may be reported using the electronic Illegal Content Notice form under Section 9 of these Terms and Conditions. For any other reports, you may contact us under Section 17.3.

5.7.4. The Client has access to CVs saved in the Employer Account, whether as a result of applications to its advertisements or by manually unlocking them in the Company’s database, only for a limited period. The Client acknowledges and accepts that access to CVs through the Employer Account is time-limited to protect Candidate Users’ personal data and comply with the storage limitation principle. Accordingly, the Company reserves the right to automatically remove from the Employer Account CVs stored in that account more than 12 months earlier, without prior notice to the Client or Recruiter Users.

5.8. Subscriptions, orders, payment and duration

5.8.1. Orders. Access to paid Services is based on orders placed by the Client through the Platform or its dedicated consultant and accepted by the Company. The structure and description of the Services are available online on the Platform or provided to Clients by the Company’s dedicated consultant. Each accepted order gives rise to the corresponding payment obligations under this article. Publishing an advertisement before payment constitutes placing an order and gives rise to the corresponding payment obligation, except for advertisements granted free of charge under Section 5.6.

5.8.2. Duration. The contractual relationship between the Company and the Client governed by these Terms and Conditions lasts for as long as the Employer Account exists. Subscriptions and Service packages have the duration specified in the order/accepted offer.

5.8.3. Price and payment methods

a) The price of the Services is specified in the invoice issued by the Company, also available in the Employer Account. Prices expressed in EUR are invoiced in RON at the National Bank of Romania exchange rate on the invoice date.

b) All payments, including applicable taxes, may be made online by card through our payment processor or by bank transfer to the bank account and within the payment deadline indicated on the invoice. Currently, Clients established abroad may purchase eJobs services and products only by online card payment.

c) Access to eJobs Services is permitted only after the transfer of funds to the Company’s account has been confirmed.

d) The Company may change its prices and/or Services, including their structure and content, at any time (including, without limitation, removing or adding Services). Changes apply exclusively to orders placed and renewals occurring after the changes have been communicated, without affecting ongoing orders accepted by the Company.

5.8.4. Invoicing. The Company issues and communicates tax invoices electronically through the RO e-Factura system in accordance with the law and also to the email address provided for this purpose. Invoices are also available in the “Order history” section of the Employer Account. The tax invoice states the number and date of the pro forma invoice (where applicable), the names of the Services purchased and their price in RON.

5.8.5. Payment deadline

a) The Client must pay the pro forma invoice within 4 days of its issue date.

b) Failure to pay on time entitles the Company to: (i) charge late payment penalties of 0.1% per day on the outstanding amount until payment in full; (ii) restrict access to the Services covered by the unpaid order until payment is made; and (iii) where payment is more than 5 days overdue, suspend access to the Employer Account under Section 10.

c) The restriction under point (ii) does not affect advertisements that are already active: Candidate Users may continue to apply to them, and the Client will gain access to the corresponding CVs after payment.

d) The Client accepts and agrees that any delay in paying amounts due to the Company constitutes a breach of these Terms and Conditions. Without prejudice to eJobs’ right to take other measures permitted by law or contract, you agree and undertake to REIMBURSE EJOBS IN FULL FOR ALL COSTS AND EXPENSES ARISING IN CONNECTION WITH THE RECOVERY OR ATTEMPTED RECOVERY OF THESE UNPAID AMOUNTS.

5.8.6. Validity of purchased Services. Services under Article 5.1.1, points a) and b), paid for by the Client must be used within a maximum of 24 months of the tax invoice date. Other Services must be used within the period communicated by eJobs when they are contracted. Services not used within the specified period expire and are removed from the Employer Account without any right to a refund.

5.8.7. Refunds. Amounts paid are not refunded if the Client requests discontinuation of the Services, except where expressly provided in these Terms and Conditions or required by law.

5.8.8. Termination of contractual relationships. The Client may terminate the contractual relationship at any time by having the Owner submit a request to close the Employer Account. Termination does not entitle the Client to a refund of amounts paid, except as expressly provided in these Terms and Conditions, and does not affect payment obligations already due or relating to Services already activated.

Without prejudice to other grounds for termination under these Terms and Conditions, the Company may unilaterally terminate its contract with the Client, in whole or in part, without giving reasons, by written notice to the Client with a 15-day notice period. Termination takes effect upon expiry of that notice period or, if later, on the date the ongoing services end under the following paragraph.

Services ongoing on the notice date, including active advertisements and campaigns, continue until the contracted period expires, but for no more than 30 days after the notice. From the notice date, the Client may no longer launch or extend services. The price of services paid for but not provided by termination will be refunded proportionately within 30 days of termination of the contractual relationship, without any further compensation.

5.8.9. Some business partners may use the eJobs Platform to promote products and services. In such cases, the agreement governing your relationship with the relevant product or service provider will be concluded separately, outside the eJobs Platform, between you and that provider, and not between you and eJobs. eJobs assumes no liability regarding those products and services and/or the legal relationships between you and those business partners.

6. Publishing CVs / recruitment advertisements through the eJobs Platform. Requirements for User-Posted Content

6.1. Responsibility for content

a) The eJobs Platform is a hosting and communication platform for Users, who are responsible for the content of information of any kind provided by and stored on behalf of Users and published on the Platform (CVs, recruitment advertisements, etc.), hereinafter “User-Posted Content”.

b) The User is solely responsible for the Content posted by that User. The Company has no general obligation to monitor User-Posted Content and is not liable for it, subject to applicable law. Measures concerning illegal or non-compliant content are applied under Sections 9 and 10.

6.2. Requirements for User-Posted Content

Publishing, transmitting and/or making any reference to User-Posted Content through the Platform are subject to the following conditions and limitations:

a. Advertisements must be drafted and published in good faith and in compliance with the law. Published advertisements must be complete and include all relevant information or conditions. Each advertisement corresponds to a single role, but may cover multiple vacancies where the recruiter seeks to hire several people to perform the same role within the company.

b. You may NOT publish, transmit or refer to any type of message containing a form of communication generally recognised in society as “advertising” for various categories of goods and services.

c. You may NOT publish, transmit or recommend to Users any unsolicited commercial message, whether sent through the communication systems provided by the Company or through other means of communication using data obtained through the Platform.

d. You may NOT publish, transmit or refer in any way in advertisements to messages recommending that a particular product or service be purchased or not purchased, except in legitimate situations referring to courses required for employment. Nor may you publish or refer in any way to messages containing confidential information, whether or not marked “confidential” or similarly labelled, or messages intended to affect the price, image or market value of a product or service.

e. You may NOT publish, upload, transmit or refer in any way to messages or other content that is illegal, threatening, abusive, indecent, discriminatory or infringes in any manner the rights of the Company, Users or third parties, or any legal provisions.

f. You may NOT publish, transmit or refer in any way to messages containing viruses or other code that proves destructive or may interrupt, remove or limit the functionality of the eJobs Platform or any other IT systems (hardware or software).

g. You may NOT collect Users’ personal data in any manner other than for the sole and direct purpose of accessing the Services provided by the Company in accordance with the law and these Terms and Conditions (i.e. applying to a job advertisement published by a Recruiter User or contacting Candidate Users in the recruitment process).

h. You may NOT restrict or remove other Users’ access to the communication platforms provided by the Company.

i. You may NOT publish, transmit or refer in any way to messages whose source is concealed.

j. You may NOT publish, transmit or refer in any way to any “pyramid scheme” or other activity intended to abuse people’s trust, or any activities similar to conduct previously shown to have criminal potential or the potential to abuse the trust of a User of the Company’s Services.

k. You may NOT provide erroneous, untrue, inaccurate or incomplete information.

l. You may NOT attempt to defraud the Company or other Users, including to obtain free advertisements or special offers granted by the Company in marketing campaigns.

m. You may NOT present a misleading, incomplete or inaccurate account, or one that is hostile towards other social groups.

n. You may NOT publish advertisements for video chat operators, erotic massage or similar activities except under the conditions in Section 5.5.5, namely only if posted by legal entities and subject to moderation by the Company.

o. You may NOT publish advertisements contrary to public morals or containing obscene language.

p. You may NOT publish incorrect or discriminatory advertisements or subsequently make the selection of Candidate Users subject to conditions other than those presented in the published recruitment advertisement and compliance with applicable law.

q. You may not upload to the Platform or publish materials that contravene any other provision of these Terms and Conditions. The Company may remove them from the Platform in accordance with the law and these Terms and Conditions.

6.3. Indemnification. A User who publishes or transmits content in breach of this article is solely responsible and shall indemnify the Company, in accordance with the law, for any damage, costs or loss of profit arising from that User’s posting, transmission of or reference to content that breaches the conditions and limitations above.

The Company does not guarantee the accuracy or completeness of Content posted by other Users, which may differ from reality. Carefully assess information before undertaking actions involving your own or third-party resources. Illegal content may be reported under Section 9.

7. Intellectual property protection

7.1. The content and design of the Platform (and any related material) sent by email or provided by any other means (e.g. articles, designs, newsletters and any other materials, hereinafter “eJobs Content”) belong to the Company and its contributors, whether or not the author is identified, and are protected by intellectual property law. Articles published on dedicated content platforms (e.g. “eJobs Carieră”, “We are HR”, etc.) may be created by the Company’s contributors, in which case the related intellectual property rights belong exclusively to the contributors who created them.

7.2. You may use the content of the eJobs Platform only for your own or the Client’s use, in accordance with the purpose for which you registered on the Platform. Any use of eJobs Content for purposes other than those expressly permitted by this document is prohibited.

You may not use or reproduce those materials, or allow anyone to do so, without written permission from the Company or its contributors holding intellectual property rights in the relevant section of the eJobs Platform’s content. Requests to use content for purposes other than those expressly permitted by this document may be emailed to contact@ejobs.ro.

Reproducing, in any manner, all or part of the information contained in Candidates’ CVs and Companies’ recruitment advertisements without the Company’s prior written consent is also prohibited.

Without prior written permission from the Company or, as applicable, its rights-holding contributors, the following are prohibited:

a. reproducing or storing eJobs Content, or sending it to any other website, server or other information storage medium;

b. modifying, publishing or transmitting materials created by reproducing, modifying or displaying eJobs Content, or participating in their transfer, sale or distribution, without obtaining our prior written permission;

c. removing markings indicating the Company’s intellectual property rights in eJobs Content.

7.3. The CV and advertisement database is a protected database in which the Company holds the sui generis right provided for by Law No. 8/1996. Extraction and/or re-utilisation of all or a substantial part of its contents, including reproduction of information in CVs and job advertisements, is prohibited without the Company’s prior written consent. Sections 5.7.2 and 6.2, point g), remain applicable.

For Clients who have purchased online database access and search services under Section 5.7, the Company grants, for the validity period of the package, a non-exclusive, non-transferable right to use the database by searching, consulting and viewing CVs, including unlocking contact details within the limits of the purchased package, exclusively for personnel recruitment under Section 5.7. This right does not include extraction and/or re-utilisation of a substantial part of the database contents, assessed qualitatively or quantitatively, or the creation of separate databases from extracted content, except for storing individual CVs accessed under Sections 5.7.2 and 5.7.5.

7.4. By publishing content on the Platform, the User grants the Company, free of charge and without territorial or time limitation, a non-exclusive right to reproduce, store, modify, adapt and communicate that content solely to the extent necessary to provide the Services. The User warrants that they hold the necessary rights in the published content and that it does not infringe third-party rights.

7.5. Automated means. The use of automated means, including scripts, robot applications, bots, spiders, crawlers and/or any computer applications/programs capable of misrepresenting or simulating certain activities or statuses on the eJobs Platform, or otherwise exploiting its functionalities or vulnerabilities to obtain advantages for oneself, other Users or third parties in using the eJobs Platform or accessing and using any Services, is prohibited.

Without prejudice to Article 36¹ of Law No. 8/1996 on copyright and related rights, systematic collection of content or data from the Platform and text and data mining (such as using automated analytical techniques to analyse text and data in digital form to generate information such as patterns, trends and correlations, including data extraction, indexing, content collection or database searching) through robots/bots or other technical, automated or manual means, and any reproduction, extraction and/or other use for the above purposes, are expressly prohibited without the Company’s prior written consent.

8. Personal data protection

8.1. The Company takes the protection of Users’ personal data seriously. Information on how the Company processes Users’ personal data (including that of Recruiter Users and other persons acting on the Client’s behalf) is provided in the Privacy Policy section.

8.2. The Company acts as an independent data controller for processing carried out for its own purposes: account creation and administration, Platform operation and security, invoicing, communications relating to the contractual relationship and marketing, in accordance with the Privacy Policy.

The Client acts as an independent controller in respect of Candidate Users’ personal data accessed through the online database access and consultation service or received through applications to its advertisements, from the time the data is accessed or received, respectively. In accordance with applicable law, in that capacity the Client has a number of corresponding rights and obligations regarding Candidate Users’ personal data accessed through the eJobs Platform, including informing data subjects and handling requests to exercise their rights in respect of processing carried out by the Client.

8.3. WHEN USING THE SERVICES PROVIDED THROUGH THE EJOBS PLATFORM, THE CLIENT ACCEPTS AND UNDERTAKES TO COMPLY WITH THE TERMS OF THE PERSONAL DATA PROCESSING AGREEMENT, WHICH FORMS AN INTEGRAL PART OF THESE TERMS AND CONDITIONS. WHEN YOU CREATE AN EMPLOYER ACCOUNT, THE TERMS AND CONDITIONS WILL ALSO INCLUDE THE PERSONAL DATA PROCESSING AGREEMENT, THE ACCEPTED VERSION OF WHICH WILL SUBSEQUENTLY BE SENT BY EMAIL.

9. Content moderation and Illegal Content Notices

9.1. The Company has no general obligation to monitor User-Posted Content or actively seek facts or circumstances indicating illegal activity or incompatibility of User-Posted Content with third-party rights, these Terms and Conditions or other legal provisions. However, the Company reserves the right to carry out voluntary own-initiative investigations to detect, identify and remove or disable access to illegal or incompatible User-Posted Content and take any necessary measures in accordance with the law and/or these Terms and Conditions.

9.2. Advertisements checked by the Company for possible errors and discriminatory content in their text will be marked “Verified advertisement”. However, the Company does not at any time guarantee the content of Advertisements, including those checked by it. Sections 9–12 and 14 of these Terms and Conditions remain fully applicable.

9.3. The User agrees to cooperate with and assist the Company in good faith, provide requested information and take actions reasonably requested by the Company in connection with any investigation it conducts into User-Posted Content on, or the use of, the eJobs Website and App, including following an Illegal Content Notice.

9.4. The Company provides Users and third parties, including trusted flaggers designated under Article 22 of Regulation (EU) 2022/2065 on a Single Market For Digital Services and amending Directive 2000/31/EC (Digital Services Act) (hereinafter the “DSA”), with means to notify the Company of allegedly illegal content directly from the eJobs Website and App using our electronic notice form (the “Illegal Content Notice”). The electronic form is available (i) within the Advertisement/CV by clicking “Report illegal content”, or (ii) through the illegal content notice form accessed by selecting “Report illegal content” in the footer of the eJobs Website and App.

9.5. To the extent possible, the reporting person must complete the Illegal Content Notice form with all information necessary for the Company to identify the illegal content, also taking account of Article 16(2) DSA, namely the following information as requested in the form:

(a) a sufficiently substantiated explanation of why the reporting person alleges that the information in question constitutes illegal content;

(b) the exact URL or URLs of the content or, where necessary, additional information enabling identification of the illegal content;

(c) the name and email address of the person submitting the notice (in accordance with the form instructions);

(d) a statement confirming the notifier’s good-faith belief that the information and allegations contained in the notice are accurate and complete.

If the mandatory fields in the Illegal Content Notice form are not completed fully or correctly, the Company may be unable to identify the allegedly illegal content or act on the notice. For example, for certain types of reported information (e.g. intellectual property infringements), it may be impossible to determine whether the information constitutes illegal content without the notifier’s identity.

9.6. The Company will acknowledge receipt of the Illegal Content Notice at the email address provided in the form. If the notifier does not provide electronic contact details, the Company will be unable to send an acknowledgement of receipt.

9.7. The Company takes decisions concerning the information referred to in notices in a timely, diligent, non-arbitrary and objective manner.

9.8. In accordance with the law, the Company will notify the individual or entity concerned of its decision regarding the information covered by the notice, providing information on the available means of redress.

9.9. The Company may request additional information and data from the person who submitted an Illegal Content Notice where needed to resolve it and where that person has provided contact details.

9.10. As part of its own-initiative investigations and/or review of Illegal Content Notices or other notices and reports, the Company uses various processes and tools to identify, review and moderate User-Posted Content. These may include human review, automated review or a combination of both. Where automated means are used to process Illegal Content Notices or make decisions on them, the Company will inform the User of their use in the decision under Section 9.8 above and/or in other cases required by law.

9.11. The Company suspends the processing of manifestly unfounded Illegal Content Notices under Section 9 of these Terms and Conditions.

9.12. A person who has submitted a notice may lodge a complaint concerning the Company’s decisions on that notice under Section 12 of these Terms and Conditions.

9.13. For clarity, illegal content must be reported exclusively using our electronic Illegal Content Notice form.

9.14. For all other reports outside the scope of this Section 9 or the requirements of the DSA, Users may contact the Company through the contact form or telephone number available in the Contact section of the eJobs Website and App.

9.15. You can view the Transparency Report on illegal content moderation here.

10. Changes, restrictive measures and suspension of access

10.1. The Company reserves the right to suspend, modify, add or delete portions of the eJobs Platform’s content at any time.

10.2. Following its own-initiative investigations, Illegal Content Notices or other notices received, the Company may also take additional investigative measures or measures restricting User-Posted Content under these Terms and Conditions.

10.3. The Company may take verification measures to establish the circumstances of the case, acting proportionately and reasonably, including, for example, contacting the reporting person, the author of the User-Posted Content (where their contact details are known), the competent authority or an external consultant.

10.4. Depending on the severity of the alleged infringement, the Company may immediately disable the content concerned, in particular the Advertisement or CV, and all associated promotion services. Disabled content will not be visible or available to persons using the Platform.

10.5. The Company may immediately take any restrictive measure concerning illegal User-Posted Content upon receipt of an order to that effect from the competent authorities under Article 9 DSA. In such a case, where it knows the relevant electronic contact details, the Company will, in accordance with the law, inform the User responsible for the illegal User-Posted Content restricted in any manner of the order received and the action taken in response, the reasons for the decision, available remedies and the territorial scope of the order.

10.6. If Users fail to comply with legal provisions or the Terms and Conditions governing use of the Platform, the Company reserves the right, at a time of its choosing (unless a specific deadline for the restriction is required by law or these Terms and Conditions) and depending on the severity of the infringement, to take the following restrictive measures:

  • refuse publication of or censor non-compliant User-Posted Content;
  • delete certain non-compliant elements of User-Posted Content;
  • permanently disable Advertisements;
  • restrict Users’ access to one of its communication platforms;
  • restrict Users’ access to some or all Platform content. For this purpose, the Company may block access to or use of the Services or any other services it provides to you;
  • suspend or block your account;
  • refuse current or future attempts to use the eJobs Platform;
  • withdraw free benefits granted;
  • terminate the contractual relationship (in situations such as repeated publication of advertisements containing illegal content, misleading job advertisements, such as those that do not represent a genuine job offer or abusively request money from candidates, repeated suspension under Section 12 of these Terms and Conditions, etc.).

10.7. The Company suspends the provision of Services to Users who frequently provide manifestly illegal User-Posted Content under Section 12 of these Terms and Conditions.

10.8. The Company may also block a Recruiter User’s access to their Platform account indefinitely if they have repeatedly published advertisements containing illegal content and/or misleading job advertisements, such as advertisements that do not represent a genuine job offer or abusively request money from candidates, or where the Company has repeatedly imposed suspension under Section 12 of these Terms and Conditions.

10.9. Where the Company knows the relevant electronic contact details, a User subject to a restriction will be informed, no later than when the restriction is imposed (or within the statutory period if the law specifies a period depending on the restriction and the User’s status), of the details of the restriction, the reasons for the decision, the legal or contractual grounds infringed and available remedies, except in the case of orders received from competent authorities or where deceptive high-volume commercial content is involved. For the avoidance of doubt, the affected User always has the right to an effective judicial remedy against a restriction decision taken by the Company.

10.10. The Company may take any action it reasonably considers necessary to comply with applicable law or an order or request of a court and/or competent authority/institution. The Company will inform the competent authorities if it becomes aware of information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of one or more persons has taken place, is taking place or is likely to take place.

10.11. An affected User who disagrees with the Company’s restriction decision may lodge a complaint under Section 11 of these Terms and Conditions.

10.12. The Company may provide data concerning the User and Content upon an order from the competent authorities, including under Article 10 DSA, and may disclose data concerning notices received to Users affected by measures taken in response to those notices.

10.13. The Company will inform a User acting in a commercial or professional capacity (hereinafter a “Business User”), under Section 10.9 above, of any restriction, suspension or termination of the provision of its Services to that Business User.

10.14. If the Company decides to terminate the provision of all Services to a User, it will send that User the notification under Section 10.9 above at least 30 days before termination takes effect. However, the Company is not required to comply with this Section 10.14 where an imperative legal ground or a legal or regulatory obligation permits it to act otherwise, or where the Business User has repeatedly breached these Terms and Conditions, without prejudice to that Business User’s right to an effective judicial remedy.

10.15. For any reason other than the application of a restriction/suspension/termination measure under Sections 10.2–10.14 above, the Company may, without further notice or formality and without having to explain its conduct, suspend or terminate your access to all or part of the eJobs Platform’s content. For this purpose, the Company may block access to or use of the Services or any other services it provides to you, or remove and delete any material from the Services. In such cases, the Company may also, at any time and without being required to account for its decision, discontinue all or part of the Services, with or without prior notice.

10.16. In such cases, Section 5.8 of the Terms and Conditions applies where relevant. Where Users’ access to paid services is restricted, they understand and agree that their claims against the Company are limited to requesting reimbursement of the portion of the fee corresponding to the restricted period, with Section 11 of these Terms and Conditions and the right to an effective judicial remedy remaining fully applicable.

11. Internal complaint-handling system

11.1. Users and persons who have submitted a notice to the Company may lodge a complaint concerning decisions taken by the Company on that notice or decisions restricting content that is illegal or incompatible with these Terms and Conditions.

11.2. A complaint may be lodged within six months of the User concerned receiving the restriction decision or the notifier being informed of the Company’s decision on their notice.

11.3. A complaint may be lodged free of charge through the Company’s internal complaint-handling system by sending it electronically to dsa@ejobsgroup.ro, in accordance with the instructions in the Company’s decision or statement of reasons.

11.4. The Company suspends processing of complaints from Users and notifiers under Section 12 below.

11.5. Where the complainant has not provided all the information needed to identify the issues raised and resolve the complaint, the Company may inform the complainant of the missing information and allow a period for clarification/compliance.

11.6. The Company handles complaints submitted through its internal complaint-handling system in accordance with Article 20 DSA, in a timely, non-discriminatory, diligent and non-arbitrary manner.

11.7. Complaints/reports will be reviewed and receive a reasoned response within a reasonable period determined by the Company according to the circumstances.

11.8. The Company may reverse its restriction decision or act on the notice received if it considers the complaint well-founded, under Article 20(4) DSA.

11.9. A complainant dissatisfied with the Company’s response may select an out-of-court dispute settlement body certified under Article 21 DSA to resolve disputes relating to the relevant measures, including complaints not resolved through our complaint-handling system. The updated list of certified bodies is published by the European Commission at https://digital-strategy.ec.europa.eu/en/policies/dsa-out-court-dispute-settlement. The Company and the complainant will engage in good faith with the selected dispute settlement body to resolve the dispute. The Company reserves the right to refuse to engage with that body where a dispute concerning the same content and the grounds for its alleged illegality or alleged incompatibility with these Terms and Conditions has already been resolved or is already subject to ongoing proceedings before a competent court or another competent out-of-court dispute settlement body.

11.10. Nothing in these Terms and Conditions affects the right to an effective judicial remedy.

12. Misuse policy

12.1. The Company suspends the provision of Services for a reasonable period to Users who frequently provide manifestly illegal content. The Company will consider Content manifestly illegal where its illegality is evident to a layperson without substantive analysis. The Company will issue a warning before such suspension.

12.2. When deciding on such suspension, the Company will consider all relevant facts and circumstances apparent from the information available to it, including: (a) the absolute number of items of manifestly illegal content submitted within a given period; (b) their relative proportion in relation to the total amount of information provided within a given period; (c) the gravity of the misuse, including the nature of the illegal content and its consequences; and (d) the intention of the User who provided the illegal Content, insofar as the Company can determine it.

12.3. For example, the Company may consider the following aggravating circumstances when deciding on such suspension:

  • the User has a history of repeatedly providing Content in breach of the law;
  • the User continues to provide illegal Content despite previous warnings and measures imposed by the Company;
  • the illegal Content involves violence, discrimination, fraud or criminal activities;
  • the User acted with a clear intention to disseminate illegal Content;
  • the User attempted to manipulate the security measures of the eJobs Platform/App to continue publishing illegal Content;
  • the User’s conduct caused significant harm to other Users, portrayed the eJobs Platform/App negatively or created an unsafe or hostile environment for other Users.

12.4. The Company may also consider the following mitigating circumstances when deciding on such suspension:

  • the User has a history of cooperating with the Company, particularly when receiving warnings, and/or providing Content in compliance with the law;
  • the User has taken proactive steps to remedy previous infringements.

12.5. The Company suspends the processing of Illegal Content Notices for a reasonable period if the notifier concerned frequently submits manifestly unfounded notices. The Company will issue a warning before such suspension. In deciding on suspension, it will consider all relevant facts and circumstances apparent from the information available to it, including (i) the volume, seriousness and frequency of unfounded notices; (ii) the proportion of unfounded notices relative to all notices submitted by that notifier; and (iii) the notifier’s intentions, insofar as the Company can determine them.

12.6. The Company suspends the processing of complaints from Users and notifiers for a reasonable period where they frequently submit manifestly unfounded complaints. The Company will issue a warning before such suspension. In deciding on suspension, it will consider all relevant facts and circumstances apparent from the information available to it, including (i) the volume, seriousness and frequency of unfounded complaints; (ii) the proportion of unfounded complaints relative to all complaints; and (iii) the User’s or notifier’s intentions, insofar as the Company can establish them.

12.7. The Company will determine the duration of suspension on a case-by-case basis, according to the circumstances, for example:

a) Minor infringements: temporary suspension for 7 days;

b) Moderate infringements: temporary suspension for 15 days;

c) Serious infringements: temporary suspension for 30 days.

13. Confidentiality

Each party shall keep confidential any non-public data, documents and information concerning the other party that it learns in connection with use of the Platform or provision of the Services, and shall not disclose them to third parties without the other party’s consent, unless disclosure is required by law or a competent authority or is necessary to exercise rights in legal proceedings. This obligation survives for 3 years after termination of the parties’ relationship. Personal data processing remains governed by Section 8.

14. Warranties and liability

14.1. The parties are liable for failure to perform or improper performance of their obligations in accordance with the law and these Terms and Conditions.

14.2. User Content. The Company makes efforts to ensure the quality and accuracy of data published on the eJobs Platform but does not guarantee that information provided by Users, including in CVs and job advertisements, is accurate, complete or up to date. Responsibility lies with the Users who published it, under Section 6.

14.3. Platform operation. The Company uses reasonable care to ensure the continuous and secure operation of the Platform and Services, keep its own information up to date and maintain appropriate security measures, without guaranteeing uninterrupted or error-free operation or the absence of any malicious code originating from third parties. Users are responsible for protecting their own equipment and systems. Information and assistance provided by the Company do not extend the warranties and obligations in these Terms and Conditions.

14.4. The Company is not liable for: (i) relationships established between the Candidate User and Clients, including recruitment processes, the content and conduct of interviews, hiring or non-hiring decisions or the conduct of Clients and Recruiter Users; (ii) Clients’ processing of the Candidate User’s data as independent controllers; or (iii) the situations set out in Section 14.5 below.

14.5. Grounds for exemption from liability. The Company is not liable for failure to perform or improper performance of its obligations to the extent caused by:

a) acts or omissions of the Client or Users, including provision of inaccurate or incomplete data;

b) failures, interruptions, congestion or deterioration of electronic communication networks, internet infrastructure or power supply outside the Company’s control;

c) incompatibilities, incorrect configuration or failures of equipment or software used by Users;

d) force majeure or a fortuitous event under Section 16;

e) compliance with mandatory legal obligations or orders issued by competent authorities (including the measures under Section 10).

14.6. Limitation of liability. In the relationship between the Company and Clients:

a) the Company is not liable for speculative or indirect damage, including loss of profit, non-pecuniary damage, loss of data, goodwill, reputation or business opportunities, or business interruption arising from use of or inability to use the Platform or Services, even if the Company was informed of the possibility of such damage;

b) the Company’s total aggregate liability to a Client for all damage arising out of or in connection with provision of the Services shall not exceed the price of the Services actually paid by that Client in the 3 months immediately preceding the event giving rise to the damage;

c) the limitations and exclusions in points a) and b) do not apply to: (i) liability for wilful misconduct or gross negligence; (ii) liability for personal injury or death; (iii) the Company’s direct payment obligations to the Client, including reimbursements and refunds under these Terms and Conditions; or (iv) any liability that cannot lawfully be excluded or limited.

In the relationship between the Company and Visitors or Candidate Users, any liability of the Company is excluded or, where exclusion is not possible, limited to the fullest extent permitted by applicable law.

14.7. Indemnification of the Company. Users’ general obligation to indemnify the Company for breaches of these Terms and Conditions is set out in Section 6.3. In addition, the Client shall indemnify the Company, its affiliates, directors, employees, collaborators and subcontractors against losses, penalties, reasonable costs and expenses (including legal fees and court costs) resulting from third-party claims, demands, investigations or proceedings (including those of Candidate Users or public authorities) based on:

a) breach by the Client or its Recruiter Users of these Terms and Conditions, including Sections 5.7.2 or 8 or the Personal Data Processing Agreement;

b) the Client’s conduct in its own recruitment processes, including its processing of Candidate Users’ data as an independent controller;

c) the Client’s provision of inaccurate, incomplete or misleading data in its account or communications with the Company.

15. Recommender systems

15.1. The Company uses recommender systems to display information on the Platform more relevantly. To make finding a suitable advertisement as easy as possible, each filtering and recommendation factor may carry more or less weight in different cases, depending on what we believe is most likely to produce a list of advertisements you may wish to view.

15.2. Advertisements published on the Platform are displayed to Users based on dedicated filters/criteria allowing selection of sorting principles. The Platform’s display and sorting criteria and filters allow:

a. displaying and sorting advertisements through a system that considers search criteria (keywords entered by the User in the advertisement search field) and specific filters predefined by the Company and selected by the User (such as job type, industry, field, education level, salary and city);

b. displaying and sorting advertisements by relevance (the default presentation of User-Posted Content);

c. displaying and sorting advertisements by their publication date on the Platform, from most recent to oldest;

d. displaying and sorting advertisements by distance. Selecting this criterion displays the advertisements closest to the searching User. To apply it, we require the User’s geolocation permission, given by selecting the dedicated button on the page for this criterion.

15.3. For the relevance-based display criterion in Section 15.2.b above, the Company uses the following 6 parameters to suggest advertisements, in order of relative importance:

  • Keywords: Advertisements containing the keywords searched for by Users more frequently and in more sections appear higher in search results. This is intended to help Users find advertisements more relevant to their search.
  • Type of Advertisement published by the Recruiter User: Visibility is influenced by the service purchased by the Client (Standard/Sprint/Business/Premium/Video). For example, an advertisement published under the Standard service appears lower in search results than one published under the Premium service.
  • Low number of applicants: Advertisements with few applicants become more prominent to distribute candidates as evenly as possible and increase the likelihood that a User’s application will be reviewed by a potential employer.
  • High number of applicants: Advertisements with many applicants become less prominent to distribute candidates as evenly as possible and increase the likelihood that a User’s application will be reviewed by a potential employer.
  • Time of publication on the Platform: More recent advertisements appear higher in search results, since older advertisements are likely to become less relevant over time, mainly due to the stage reached in the selection process.
  • Time of update on the Platform: Updated advertisements appear higher in search results because an update suggests that the selection process remains at a stage relevant to new applicants.

15.4. Users are free to choose between the advertisement display criteria in Sections 15.2.b–15.2.d above. If none is selected, Advertisements are displayed by relevance under Section 15.2.b.

15.5. Users are also free to select or not select the Company’s predefined filters available on the Advertisement search page and to enter or not enter their preferred keywords in the search field under Section 15.2.a above. Depending on the filters the User applies to narrow search results to specific Advertisement parameters and on the expressions or phrases searched for, different parameters may increase or decrease the final matching score and the position of individual Advertisements in search results.

15.6. Users may also receive recommendations for other similar advertisements on the Platform. These recommendations are generated using an Artificial Intelligence program based on the semantic similarity of the titles/content of those advertisements.

15.7. Candidate Users who have created or uploaded CVs on the eJobs Platform may also receive advertisement recommendations based on the experience or education stated in their CV. Candidate Users may influence the display of these advertisements by changing their CV information about experience or education in accordance with these Terms and Conditions.

16. Force majeure

16.1. Neither party is liable for failure or delay in performing its obligations if caused by a force majeure event — an external, unforeseeable, absolutely insurmountable and unavoidable event (Article 1351 of the Civil Code) — or, as provided by law, a fortuitous event. Examples include natural disasters, war, acts of terrorism, epidemics or pandemics, general strikes, major regional or national disruptions to energy or communication infrastructure, large-scale cyberattacks that could not have been prevented by reasonable security measures, and acts of public authorities preventing performance.

16.2. The party invoking force majeure must notify the other party through the channels in Section 17.3 or, for events affecting all Users, by publication on the Platform, as soon as possible and no later than 5 days after the event occurs, and use reasonable efforts to limit its effects.

16.3. Affected obligations are suspended for the duration of the event. Payment obligations for Services already provided remain due.

16.4. If the event lasts more than 30 days, either party may terminate the affected contractual relationship by notice, without compensation.

17. Miscellaneous

17.1. Changes to this document

a) THE COMPANY RESERVES THE RIGHT TO UPDATE THESE TERMS AND CONDITIONS PERIODICALLY (E.G. TO REFLECT CHANGES IN LEGISLATION OR IN THE SERVICES PROVIDED BY THE COMPANY). USERS WILL BE NOTIFIED OF UPDATES/CHANGES TO THE TERMS AND CONDITIONS. Updates/changes take effect on the date stated in the notice.

b) Changes/updates will not be implemented (i) in relation to Clients before expiry of a notice period of at least 15 days from notification of the changes (unless a longer notice period applies under the contract with the relevant User), or (ii) for other categories of Users notified as required by law, before the period stated in the notice, where applicable. During the notice period, Clients and other categories of notified Users, where applicable, may terminate their contract with the Company. For Clients, termination takes effect within 15 days of receipt of the termination notice, unless a shorter termination period applies under the Client’s contract. Provision of new services to the Client through the Platform during the notice period is considered a clear affirmative action waiving that notice period, except where it exceeds 15 days because the changes to the Terms and Conditions require the Client to make significant technical adjustments. The notice period does not apply if the Business User or other categories of Users, as applicable, waive it in writing or if the Company:

(a) is subject to a legal or regulatory obligation requiring it to change the Terms and Conditions in a manner that does not allow it to comply with the above notice period;

(b) exceptionally needs to change its Terms and Conditions to address an unforeseen and imminent danger related to protecting the Services and Users against fraud, malware, spam, data breaches or other cybersecurity risks.

c) Certain eJobs services may also be subject to different terms, which will be prominently displayed for each such service and accessible before it is used.

d) Unless the contract is terminated before the changes take effect, use of the eJobs Platform Services after that date constitutes acceptance of the amended Terms and Conditions.

e) Termination of contractual relationships for any reason does not affect provisions intended by their nature or wording to survive termination.

17.2. Advertising and content provided by other parties

a) Parts of the Platform’s content may be provided by third parties with whom the Company has content supply agreements. The Platform may also include advertising sections displaying third-party advertisements in accordance with the law. The Company is not responsible in any way for third-party content, whether or not it is advertising. Nor is the Company responsible for the content of pages linked from the Platform.

17.3. Notices

a) Except for Illegal Content Notices under Section 9.4 above or other reports under Section 9.14 above, all other notices to eJobs must be sent in writing, by email to contact@ejobs.ro or by post.

b) Unless the User communicates a change, replies to notices will be sent to the contact details provided by the User, and those notices will be deemed received by the User.

c) We also inform you that the DSA Contact section, accessible by selecting the “DSA Contact” button in the footer of the eJobs Website and App, contains the following information under Articles 11 and 12 DSA:

  • the single point of contact for Member State authorities, the European Commission, the Board referred to in Article 61 DSA and trusted flaggers;
  • the single point of contact for recipients of our Services.

17.4. Governing law and jurisdiction

a) The parties’ rights and obligations under these Terms and Conditions and all legal effects arising from them are interpreted and governed by Romanian law in force.

b) Any dispute regarding the interpretation, performance or validity of these Terms and Conditions will be resolved amicably between the parties. If this is not possible, the dispute may be submitted to the competent Romanian courts.

Disputes with Clients fall within the jurisdiction of the courts at the Company’s registered office. Disputes with Candidate Users fall within the jurisdiction of the courts determined by law.

Candidate Users may also choose an alternative dispute resolution method, such as through consumer protection offices at https://anpc.ro/ or the alternative dispute resolution (ADR) procedure in Romania at https://reclamatiisal.anpc.ro/.

To exercise your rights concerning processing by those persons, please contact them directly. Rights concerning processing by the Company are exercised against Us under Section 6.

2. What data do we process?

We process the following categories of personal data:

Data you provide directly

Creating a User account

When creating an account on the Platform, you must provide the data requested in the relevant registration form, such as identification details, contact details and date of birth (for Candidate Users).

When creating an Employer Account, you also provide identification details of the company you represent (tax identification number, registration number), which are checked against public registers, and, during initial setup, the contact person’s details (surname, first name, email, telephone number, correspondence address and job title).

Data in the Candidate User profile and CVs

You may include various information in your profile and the CVs forming part of your Candidate User account, such as education, professional experience, skills, photographs, preferred job characteristics, information about abilities, etc. You determine the content of your CV. We recommend that you do not include special categories of personal data (e.g. health, trade union membership, religion, etc.).

Other data you provide directly when using the eJobs Platform or interacting with eJobs

We store information received from you through requests sent by email or chat or when you take part in our surveys and questionnaires. If you use our remote interview services (Video Interview), we also process your image and voice through the online conferencing services implemented on the eJobs Platform. We process recordings of your calls with eJobs representatives, including sales agents, or through our Call Centre service.

Data collected or generated by us through your interaction with the eJobs Platform

We log information about when and/or how you visit or use eJobs Services, including how Candidate Users, Clients and Recruiter Users use the eJobs Platform (e.g. whether you updated your CV, applied for a job, posted a new recruitment advertisement or purchased credits).

We also use cookies and similar technologies to recognise you and your devices, and allow others to use cookies. How we use these technologies is described in the Cookies Policy.

When you use the eJobs Platform (including cookies or similar technologies on other parties’ websites), we also receive information about your IP address, IP-based location, proxy server, operating system, web browser and add-ons, and device identifier. If you use our services on a mobile device, it will send us geolocation data based on its settings. We will ask for your consent before using geolocation or other tools to identify your location.

Data obtained from third parties or other sources

  • Google or Apple authentication (Candidate Users): if you choose to create an account through your Google or Apple account, we retrieve certain public profile data (e.g. surname, first name, profile picture, email address and/or telephone number) to create your Candidate Account;
  • Public sources (Employer Accounts): when creating and verifying the account, we retrieve and check public register data (Ministry of Finance records — www.mfinante.ro): the Client’s name, registration number, registered office and tax status;
  • Data provided by your employer: if you are a Recruiter User invited to the Client’s Employer Account or its designated contact person, your data (as applicable, contact details, identification details and job title) is provided by the Client in whose name and on whose behalf you act, directly or through its authorised persons;
  • Interaction with third-party services: we receive information about your visits and interactions with other entities’ services when you visit services of other providers that include advertisements, cookies or similar technologies.

3. Why do we process your personal data?

The following explains the purposes for which we collect and process your personal data and the legal bases for processing.

3.1. Use of the Services by Candidate Users

To enjoy all the features offered by the eJobs Platform, you must create a User account. It enables you to access Services dedicated to Candidate Users, such as creating a CV, applying for a job, viewing job advertisements, contacting Recruiter Users and receiving notifications and alerts about recruitment advertisements published by Recruiter Users. Legal basis: Article 6(1)(b) GDPR — entering into and performing a contract.

The eJobs Platform may also be used by employers outside the European Economic Area, including countries not recognised by a European Commission decision as providing an adequate level of protection. Your data may be processed by such an employer if you apply to its recruitment advertisement or it accesses your public CV. Such transfers comply with Chapter V GDPR: they are based on a European Commission adequacy decision or appropriate safeguards under Article 46 GDPR, such as standard contractual clauses concluded between the Company and the employer. In their absence, transmission of your direct application to an employer outside the EEA may rely on the derogations in Article 49(1) GDPR. You may obtain further information about the safeguards applicable to a transfer, including a copy, by submitting a request under Section 1.

We process personal data in your CV, namely professional experience, to display employer and job recommendations on the eJobs Platform. The recommendations eJobs provides within the Platform facilitate your job search and application process. Legal basis: Article 6(1)(f) GDPR — legitimate interests.

We may also use certain data you provide to optimise our job recommendations or suggestions for completing your CV. We also use data received from Candidate Users to create features for filtering Candidate Users according to various criteria of interest to Clients. Legal basis: Article 6(1)(f) GDPR — legitimate interests. We have a legitimate interest in improving our Services and providing suggestions/advice to Candidate Users to maximise the success of our Services. We also seek to provide Clients with an efficient indicator search service.

Exercising the right to object. You may object at any time, on grounds relating to your particular situation, to processing based on legitimate interests pursued by eJobs or third parties by emailing dpo@ejobsgroup.ro or using any contact method in Section 1.

3.2. Use of the Services by Clients and Recruiter Users

Creating and administering the Employer Account and Recruiter User accounts. We process data of the person registering the Employer Account, Recruiter Users invited to the account and the Client’s contact persons to create, verify and administer user accounts, manage Roles and permissions and validate contact details. Legal basis: Article 6(1)(b) GDPR — entering into and performing a contract or taking pre-contractual steps, for Clients who are authorised sole traders; and Article 6(1)(f) GDPR — legitimate interests, for personal data of Recruiter Users and contact persons acting in the Client’s name and on its behalf. Our legitimate interest is the proper conduct of contractual relationships with our corporate Clients. Individuals’ rights and interests (i.e. those of Clients’ representatives) are not adversely affected, as processing is inherent in their employment/collaboration relationship with the Client in whose name and on whose behalf they act.

Account approval and fraud prevention. We verify registration data, including against public registers, may carry out sample checks of whether the account creator or contact person represents the Client and may request supporting documents in cases provided by the Platform’s Terms and Conditions (e.g. recruitment for positions abroad, replacement of the Owner, etc.). We also use certain personal data associated with accounts to prevent fraud and misuse of Platform features (including free benefits). Legal basis: Article 6(1)(f) GDPR — the legitimate interest in ensuring that Services are used by genuine, active entities and authorised persons, protecting both Candidate Users and the integrity of the Platform.

Conducting and managing the Client relationship. We retain the declaration of authority to represent the Client made by the person registering the account or acquiring the Owner Role, evidence of acceptance of the Terms and Conditions and their updates, evidence of communication of other legal information and documents, and logs of account actions, to evidence transactions performed in the Client’s name and on its behalf and ensure traceability of Platform use. Legal basis: Article 6(1)(f) GDPR — the legitimate interest in ensuring legal certainty in contractual relationships and traceability of transactions.

Our representatives (account managers and/or other eJobs employees with relevant duties) may also contact Recruiter Users by telephone or email to confirm and activate accounts, assist with the Services and manage operational or commercial aspects of the relationship. Legal basis (depending on the specific purpose of contact): Article 6(1)(b) GDPR — entering into and performing a contract, or Article 6(1)(f) GDPR — legitimate interests, for Clients who are authorised sole traders; and Article 6(1)(f) GDPR — legitimate interests, for personal data of Recruiter Users and contact persons acting on behalf of the Client.

Invoicing and collecting payment for Services. We process data needed to issue invoices, process payments and recover amounts due from Clients, contact person data, identification details of Clients who are authorised sole traders, Clients’ bank details and payment transaction data. Legal basis: Article 6(1)(b) GDPR — performance of a contract; Article 6(1)(c) GDPR — compliance with tax and accounting obligations (including retaining supporting documents for legally required periods); and Article 6(1)(f) GDPR — the legitimate interest in recovering debts, for debt recovery measures.

Exercising the right to object. You may object at any time, on grounds relating to your particular situation, to processing based on legitimate interests pursued by eJobs or third parties by emailing dpo@ejobsgroup.ro or using any contact method in Section 1.

Notifications relating to Our Services. Recruiter Users and Clients may receive information from Us about provision of the Services and use of the Employer Account, such as notifications of applications received for published advertisements, expiry of active advertisements or purchased services, and information about functionalities associated with the contracted Services. Information strictly necessary to provide the Services cannot be disabled while the relevant Service is being used; other notifications may be disabled through the available account settings. Legal basis: Article 6(1)(b) GDPR — entering into and performing a contract, or Article 6(1)(f) GDPR — legitimate interests, for Clients who are authorised sole traders; and Article 6(1)(f) GDPR — the legitimate interest in ensuring proper use of Services by Clients, for Recruiter Users and contact persons acting in their name and on their behalf.

Exercising the right to object. You may object at any time, on grounds relating to your particular situation, to processing based on legitimate interests pursued by eJobs or third parties by emailing dpo@ejobsgroup.ro or using any contact method in Section 1.

3.3. Managing User relationships and support

We process certain personal data to manage relationships with all eJobs Platform Users, for example when they contact us with questions or requests about Platform functionalities or malfunctions. Legal basis: Article 6(1)(f) GDPR — our legitimate interest in providing adequate services to all Users.

Exercising the right to object. You may object at any time, on grounds relating to your particular situation, to processing based on legitimate interests pursued by eJobs or third parties by emailing dpo@ejobsgroup.ro or using any contact method in Section 1.

3.4. Other information about the Services

Users may receive various notifications from Us relating to provision of the Services (e.g. whether a Recruiter User has viewed their CV, whether saved jobs are about to expire, reminders to update their CV, alerts about scheduled interviews and other email and SMS notifications strictly related to applications). We process this data based on our legitimate interest under Article 6(1)(f) GDPR. We consider that this interest does not infringe data subjects’ rights and interests because the notifications are closely related to the requested Services. Users may also disable these notifications at any time through their account settings.

Exercising the right to object. You may object at any time, on grounds relating to your particular situation, to processing based on legitimate interests pursued by eJobs or third parties by emailing dpo@ejobsgroup.ro or using any contact method in Section 1.

3.5. Sending commercial communications

We wish to send you promotional materials, inform you about new Company services, invite you to participate in surveys or questionnaires and communicate similar information we believe may interest you, including, if you agree, promotional materials/marketing communications about the products/services of the Company’s partners.

We will send these communications if we have your consent. Legal basis: Article 6(1)(a) GDPR — consent.

Users may unsubscribe at any time. For example, if you withdraw consent to content communications (Newsletter), we will no longer be able to send you our articles published on the content platforms.

Where we have consent to commercial communications, we may also, in certain cases, combine information collected from you with data resulting from your interaction with eJobs Platform Services for use in our marketing communications. Legal basis: Article 6(1)(f) GDPR — legitimate interests. We seek to make our marketing more effective by offering Clients relevant, personalised service offers.

3.6. Use of geolocation services

We will request your consent when you use your device’s geolocation feature. Legal basis: Article 6(1)(a) GDPR — consent.

3.7. Analytics and statistics regarding operation of the eJobs Platform, cookies and similar technologies

We may use personal data provided by Users (including information supplied during initial account setup) or collected in connection with use of the Services to produce analyses and statistics about our Services, including how the eJobs Platform operates. Legal basis: Article 6(1)(f) GDPR — legitimate interests. These analyses and statistics help us understand how to improve our Services or Platform functionalities. We also use cookies and similar technologies for analytics and statistics in accordance with the Cookies Policy. Depending on the type of cookies and similar technologies used, the legal basis is Article 4(6)(b) of Law No. 506/2004 concerning the processing of personal data and the protection of privacy in the electronic communications sector and Article 6(1)(f) GDPR — legitimate interests, for strictly necessary cookies; or Article 4(5) of Law No. 506/2004 and Article 6(1)(a) GDPR — consent, for functional, analytics, tracking and behavioural advertising cookies.

Exercising the right to object. You may object at any time, on grounds relating to your particular situation, to processing based on legitimate interests pursued by eJobs or third parties by emailing dpo@ejobsgroup.ro or using any contact method in Section 1.

3.8. Signing in through Google and Apple services

Candidate Users may sign in or create an account through Google and Apple plugins enabling connection through their personal Google or Apple account. When they use this feature, the eJobs Platform retrieves some public data from their Google/Apple account (e.g. surname, first name, email address and/or telephone number). This data is necessary to create the User account; the legal basis is therefore Article 6(1)(b) GDPR — entering into and performing a contract.

3.9. Compliance with legal obligations

Processing is sometimes necessary to comply with our legal obligations (legal basis: Article 6(1)(c) GDPR — compliance with a legal obligation), such as:

  • paying relevant taxes and contributions, reporting to the relevant tax authorities and keeping accounting records;
  • archiving data in accordance with applicable law.

3.10. Defending rights and interests in legal proceedings

We may also process personal data to establish, exercise or defend legal claims in court proceedings, administrative proceedings or other official proceedings involving the Company (legal basis: Article 6(1)(f) GDPR — the legitimate interest in defending the controller’s rights and interests).

Exercising the right to object. You may object at any time, on grounds relating to your particular situation, to processing based on legitimate interests pursued by eJobs or third parties by emailing dpo@ejobsgroup.ro or using any contact method in Section 1.

3.11. Recommendations

We process relevant data (e.g. professional experience, foreign language knowledge/proficiency and location) from Candidate Users’ public CVs to identify, using artificial intelligence, Candidate Users potentially suitable for job advertisements published on the eJobs Platform by Recruiter Users.

For this purpose, we automatically select, using artificial intelligence, only Candidate Users’ public CVs that match the criteria/requirements set by Recruiter Users in job advertisements.

For example, if a Recruiter User publishes a job advertisement requiring a candidate with 10 years’ sales experience, French language skills and a category B driving licence, in addition to the standard Platform search features, a number of Candidate User recommendations will be selected and displayed to the Recruiter User from among those with public CVs who have not applied to that advertisement and may meet the criteria/requirements it contains.

Part of the process of identifying and selecting Candidate Users potentially suitable for Recruiter Users’ job advertisements on the eJobs Platform involves profiling under Article 4(4) GDPR, meaning any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

Please note that eJobs’ processing for this purpose does not in any way result in eJobs taking decisions about you that could produce legal effects concerning your rights or similarly significantly affect your rights/interests.

We also inform you that eJobs takes all reasonable measures to: (i) protect your personal data (for example, CV sections intended for identification/contact details are not processed for this purpose); and (ii) ensure the accuracy of Candidate User recommendations displayed to Recruiter Users in relation to the requirements/criteria in their job advertisements.

If you wish to exercise your right to rectification or any other data subject right, please refer to Section 6 of this Privacy Policy.

Legal basis: Article 6(1)(f) GDPR — eJobs’ legitimate interest in facilitating identification of suitable Candidate Users for Recruiter Users’ job advertisements on the eJobs Platform.

Exercising the right to object. You may object at any time, on grounds relating to your particular situation, to processing based on legitimate interests pursued by eJobs or third parties by emailing dpo@ejobsgroup.ro or using any contact method in Section 1.

3.12. Content moderation and compliance with the Digital Services Act (DSA)

We process personal data in connection with moderation of User-Posted Content on the Platform, namely: data of persons sending Illegal Content Notices (name, email address, notice content); data of Users whose content is subject to a notice, investigation or restrictive measure; and data of persons lodging complaints through our internal complaint-handling system. For this purpose, we review notices and complaints, take and communicate decisions, apply measures under the Platform’s Terms and Conditions and prepare transparency reports using aggregated data. Legal basis: Article 6(1)(c) GDPR — compliance with our legal obligations under Regulation (EU) 2022/2065 (DSA); and Article 6(1)(f) GDPR — the legitimate interest in maintaining a safe, compliant Platform environment, for measures going beyond minimum legal obligations.

Exercising the right to object. You may object at any time, on grounds relating to your particular situation, to processing based on legitimate interests pursued by eJobs or third parties by emailing dpo@ejobsgroup.ro or using any contact method in Section 1.

3.13. Platform security

We process technical data and usage logs (e.g. IP addresses, device identifiers, login events and account actions) to secure the Platform and accounts, detect and prevent unauthorised access, cyberattacks and other security incidents, and investigate and remedy such incidents, including to comply with our breach notification obligations. Legal basis: Article 6(1)(f) GDPR — the legitimate interest in protecting the Platform, Users’ data and the integrity of the Services.

Exercising the right to object. You may object at any time, on grounds relating to your particular situation, to processing based on legitimate interests pursued by eJobs or third parties by emailing dpo@ejobsgroup.ro or using any contact method in Section 1.

4. To whom do we disclose data?

We may disclose your personal data to: (i) entities and/or processors and subprocessors appointed by us (in the EEA or third countries) involved in providing the Services, including commercial communications, such as data centre providers, payment service providers for payment features on the eJobs Platform, email platform providers such as Google Mail, the artificial intelligence systems platform provider Palantir Technologies Inc. for the processing purpose described in Section 3.11 above, and Ringier AG for intra-group services related to the Palantir Technologies Inc. platform for the purpose in Section 3.11 above; (ii) Clients (employers), including those outside the EU/EEA, where applicable; (iii) where we must disclose personal data to comply with a legal obligation or a decision of a judicial authority, public authority or governmental body; or (iv) where otherwise required or permitted by applicable law. Your personal data may also be disclosed to third-party providers of cookies and similar technologies as described in the Cookies Policy.

Some recipients are outside the European Union and the European Economic Area, including in the United States, and international data transfers occur in our dealings with them. We transfer personal data only using appropriate transfer mechanisms (e.g. transfers to countries recognised as providing adequate data protection or subject to appropriate safeguards such as standard contractual clauses).

Transfers to the United States will also take place under Article 45 GDPR on the basis of Commission Implementing Decision (EU) 2023/1795 of 10 July 2023 pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council on the adequate level of protection of personal data under the EU–US Data Privacy Framework. Following adoption of that Decision, personal data may flow safely from the EU to US companies participating in the Framework without additional data protection safeguards being required. Certified entities participating in the Framework can be viewed here.

5. How long do we retain data?

We retain your personal data for as long as necessary to fulfil the purposes for which it was collected, in accordance with internal retention procedures, including applicable archiving rules.

Generally, Candidate Users’ data is retained for as long as they have a Candidate User account on the eJobs Platform. Personal data will be deleted if the Candidate User requests account deactivation and deletion or after no more than 5 years from becoming inactive (i.e. from the last interaction on the eJobs Platform).

Candidate Users’ CVs are retained for 12 months from the date Recruiter Users save them in the Employer Account on the eJobs Platform. At the end of that period, CVs are deleted from the Employer Account regardless of why they were stored and can no longer be accessed through that account on the Platform. eJobs sets this retention period in accordance with GDPR principles and obligations, including Articles 5(1)(e) and 25(2).

Recruiter Users’ data (authorised sole traders and representatives acting in the Client’s name and on its behalf) is retained while their accounts exist. Data of contact persons acting for the Client is retained for the duration of the contractual relationship with the Client.

Financial and accounting data is retained for the full statutory period for archiving and retaining financial and accounting documents.

Evidence of contractual relationships (the declaration of authority, evidence of acceptance of the Terms and Conditions and logs of relevant transactions) is stored for the contractual relationship and subsequently for the general limitation period under applicable law.

For processing based on your consent, we retain personal data while we have that consent, unless we process it on another legal basis or another statutory exception applies. For example, if you consented to commercial emails and withdraw consent, we will no longer send them. However, We may continue retaining the email address for another purpose (e.g. an active Platform account).

Platform logs (security logs, account action logs and data used to prevent fraud) are retained for periods determined for each category according to: technical and operational necessity (detecting and investigating security incidents or misuse); the evidentiary value of recorded transactions (logs evidencing transactions with legal effects follow the rules for evidence of contractual relationships); an ongoing incident, investigation or dispute (relevant logs are retained until final resolution); and any statutory retention obligations.

Content moderation data (Illegal Content Notices, decisions and their reasons, complaints lodged through the internal system and related correspondence) is retained for periods determined according to: final resolution of the notice or complaint, including expiry of the period for challenging the decision through the internal complaint-handling system (6 months under the Terms and Conditions) or other statutory remedies; the need to demonstrate compliance with Regulation (EU) 2022/2065 (DSA), including before competent authorities; application of the misuse policy (the history of manifestly unfounded notices and repeated infringements, to the extent necessary to assess frequency); and any ongoing investigation, authority request or dispute, in which case relevant data is retained until final resolution. Transparency reports use aggregated data that does not identify individuals.

Cookie and similar technology data is retained according to the specific periods set for those technologies, ranging from the browsing session (session cookies) to up to 2 years (analytics cookies).

The Company will not delete data from its databases if another legal basis exists for storage and processing in accordance with applicable data protection law, for example where necessary to establish, exercise or defend legal claims or where another statutory exception applies.

6. What rights do you have as a data subject?

The law grants you the following rights as a data subject:

a. Right of access

You may obtain confirmation from us that we process your personal data and information about the processing. This right allows you to obtain a copy of the processed personal data free of charge and additional copies for a fee. If you ask us to confirm whether we process your data and we transfer it outside the EU and EEA, you are entitled to information about our safeguards for that transfer.

b. Right to rectification

You may ask us to correct inaccurate personal data or complete incomplete data, as applicable.

c. Right to erasure

You may request erasure where: (i) data is no longer necessary for the purposes for which we collected and process it; (ii) you have withdrawn consent and we cannot process it on another legal basis; (iii) processing is unlawful; or (iv) relevant legislation requires erasure.

Erasure may be refused in whole or in part in cases provided by law, for example where retention is necessary to comply with a legal obligation or establish, exercise or defend legal claims (see also Section 5).

d. Withdrawal of consent and right to object

You may withdraw consent to consent-based processing at any time. Withdrawal does not affect the lawfulness of processing before withdrawal.

You may object at any time to processing based on our legitimate interests on grounds relating to your particular situation. We will then stop processing your data unless (i) we demonstrate compelling legitimate grounds overriding your interests, rights and freedoms or (ii) processing is for establishing, exercising or defending legal claims. You may always object to processing for direct marketing based on our legitimate interests, regardless of your reason. Where marketing relies on consent, you may withdraw it.

e. Right to restriction of processing

You may request restriction if: (i) you contest the accuracy of personal data, for a period enabling us to verify it; (ii) processing is unlawful and you oppose erasure, requesting restriction of use instead; (iii) we no longer need the data for processing but you require it for legal proceedings; or (iv) you have objected to processing, pending verification of whether our legitimate grounds as controller override your rights as a data subject.

f. Right to data portability

Where processing is based on consent or a contract and carried out by automated means, you may request, subject to the law, that data you provided to us be supplied in a structured, commonly used, machine-readable format. At your request, we may transmit your data to another entity where technically feasible.

g. Right not to be subject to automated individual decision-making, including profiling.

h. Right to lodge a complaint with the national supervisory authority

If you believe your rights have been infringed, you may lodge a complaint with the personal data processing supervisory authority:

Romanian National Supervisory Authority for Personal Data Processing (ANSPDCP — www.dataprotection.ro), B-dul G-ral. Gheorghe Magheru 28–30, District 1, postcode 010336, Bucharest, Romania, anspdcp@dataprotection.ro.

TO EXERCISE THE ABOVE RIGHTS, PLEASE CONTACT US USING THE DETAILS IN SECTION 1 (DPO CONTACT DETAILS).

These rights are exercised against the Company for processing carried out by Us. For processing by employers who accessed your CV or received your application as independent controllers, please contact them directly.

The Company may also be contacted using the contact details and mechanisms available on the eJobs Platform. Users may exercise certain rights (editing, rectification, objection to commercial communications or erasure) directly on the Platform through the settings in the MY ACCOUNT section.

POLICY ON COOKIES AND OTHER SIMILAR TECHNOLOGIES

eJobs may set or read cookies and device identifiers when you use the eJobs Platform or visit a website, application or service that uses our Services.

1. Useful information about cookies and device identifiers

1.1. What is a “cookie”?

An “Internet Cookie” (also known as a “browser cookie”, “HTTP cookie” or simply a “cookie”) is a small file consisting of letters and numbers stored on a user’s computer, mobile terminal or other equipment used to access the Internet.

A cookie is installed through a request sent by a web server to a browser (e.g. Edge, Firefox, Chrome, Safari) and is entirely “passive” (it contains no software, viruses or spyware and cannot access information on the user’s hard drive). It stores certain information (e.g. preferred language or webpage settings) that your browser may send back to us when you revisit the webpage, depending on the cookie’s lifespan.

Cookies themselves do not require personal information to function and, in most cases, do not personally identify internet users.

1.2. What types of cookies are there?

Cookies are classified by lifespan, purpose and source, as follows:

a. Types of cookies by lifespan

Session cookies

These are temporarily stored in the web browser’s cookie folder until the user leaves the website or closes the browser window (e.g. when signing into/out of webmail or social media accounts).

Persistent cookies

These are stored on a computer’s or device’s hard drive, generally for a predefined lifespan. Persistent cookies also include those placed by a website other than the one currently visited — known as “third-party cookies” — which may be used anonymously to remember a user’s interests so that the advertising delivered is as relevant as possible.

b. Types of cookies by purpose

Strictly necessary cookies

These cookies are necessary for websites to function properly. They enable you to navigate the website and use its features. Without them, we cannot provide certain features, such as automatic redirection to the least busy server or remembering your wish list.

Functional cookies

Functional cookies record information about users’ choices and allow website operators to personalise the website to users’ requirements. For example, they may save category/segment preferences.

Performance and analytics cookies

These cookies enable website operators to monitor visits, traffic sources and how users interact with a website or particular sections of it.

Information from analytics cookies helps operators understand how visitors use websites and improve the presentation of content.

Targeting and advertising cookies

These cookies may enable monitoring of users’ online activities and creation of user profiles for marketing. For example, cookies may identify products and services a user likes, allowing relevant advertisements to be sent to that user.

c. First-party versus third-party cookies

Every cookie has a “responsible party” (i.e. the website/internet domain) that places it.

First-party cookies are placed by the internet domain/website accessed by the user, whose address appears in the browser’s address bar. For example, if the user visits www.ejobs.ro and the cookie placed on their computer has the domain www.ejobs.ro, it is a first-party cookie.

A third-party cookie is placed by an internet domain/website other than the one accessed by the user. This means the visited website also contains information from a third-party website, such as an advertising banner. Thus, if a user visits www.ejobs.ro but the cookie placed on their computer has the domain doublecklick.net, it is a third-party cookie.

d. Embedded content (social media buttons, applications and widgets)

Webpages may implement third-party social media buttons or widgets enabling users to interact with the websites whose buttons or widgets are embedded. Interaction with third-party buttons or widgets enables that third party to collect certain information about the user, including IP address, page header information and browser information.

e. How do targeting and advertising cookies work?

Generally, browsing activity data is collected and analysed anonymously. If the analysis identifies a particular interest, a cookie — a small text file used by most websites to store information that improves browsing — is placed on the User’s computer and determines the advertisement the User receives, known as interest-based advertising.

Interest-based advertising delivers advertisements on the websites you visit and makes them more relevant to your interests. Shared interests are grouped based on previous browsing activity, and users receive only advertisements matching their interests. This makes advertising relevant and as useful as possible.

To help explain...

Imagine you want to change jobs or are looking for a job. You visit a section of a specialist website (e.g. www.ejobs.ro) and read relevant articles about career advice or jobs.

The next time you browse online, for example to read a news article or visit an online shop, you will receive an advertisement for a job offer published on a specialist website such as www.ejobs.ro.

You receive these personalised advertisements because you and others like you have shown increased interest in these services. This may improve the online experience by reducing irrelevant advertisements.

2. What types of cookies and device identifiers do we use?

A detailed list of the cookies and device identifiers used is provided below.

You may withdraw consent to cookies at any time (except those necessary to use the eJobs.ro Platform) by changing your choices in the available cookie settings.

You can also configure your browser to block necessary cookies, but the Website may not function properly. Disabling other types of cookies may also affect the Website’s functionality or your experience of using it.

2.1. Necessary cookies

Google Analytics services

eJobs.ro uses Google Analytics, a web analytics service of Google Inc., located at 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (“Google”).

Based on your consent, Google analyses your use of our website on our behalf. For this purpose, we use, among others, the cookies detailed above. Information Google collects about your use of eJobs.ro (e.g. referral URL, webpages visited, browser type, language settings, operating system and screen resolution) is sent to a Google server in the United States for storage and analysis; the results are subsequently made available to us in anonymised form. Traffic data is not attributed to your full IP address. We have enabled Google’s IP anonymisation feature on our website so that the last 8 digits (IPv4) or last 80 bits (IPv6) of your IP address are deleted.

Google is also certified under the EU–US Privacy Shield standards, which ensure an adequate level of data protection for Google’s processing in the US.

Most advertisements you see on the Website are served by eJobs and/or Ringier România. However, we also allow other companies to provide advertising materials and collect information through cookies or similar third-party technologies included on the Website. These targeting technologies accompanying advertisements viewed by Users allow those companies to monitor advertising effectiveness. They use this data to determine whether you have seen a particular advertisement or identify you in their database, and subsequently serve other advertising matching your interests.

We make reasonable efforts to ensure that our online advertising partners, whom we allow to add identifiers or code to the Website, handle personal data obtained from our Website responsibly.
