EJOBS TERMS AND CONDITIONS

1.  General aspects

These Terms and Conditions (the "Terms and Conditions") govern the relationship between eJobs Group SRL, a limited liability company, with its headquarters in Dimitrie Pompeiu Blvd, No. 9-9A, Sector 2, Bucharest, Romania ("The Company " or "Us") and the persons using ("the User") the site www.eJobs.ro (the "Site" or "eJobs.ro") and / or the equivalent eJobs application that can be run on mobile, smartphone and / or tablet available in mobile app stores (such as Google Play or App Store) and / or the services offered by the Company through the Site or the Application (the "Services").

Access to and use of the Site, the eJobs Application, including any page or component section thereof, or any Service provided through the Site or the eJobs Application may be made only in accordance with these Terms and Conditions, including the Privacy Policy and Cookie Policy.

FOR THE USE OF THE SERVICES, WE MAY REQUIRE THE USER TO EXPRESS AGREEMENT WITH THESE TERMS AND CONDITIONS THROUGH A SPECIFIC ACTION WHICH HAS THE SIGNIFICANCE OF A NON-COMMERCIAL AGREEMENT (E.G. CHECKING THE SPECIFIC "I HAVE READ AND AGREE WITH THE TERMS AND CONDITIONS OF EJOBS" BOX).

BY CHECKING A CERTAIN BOX, THE USER:

A.  EXPRESSLY AGREES TO COMPLY WITH ALL CLAUSES IN THIS SET OF TERMS AND CONDITIONS, AND ANY OTHER TERMS AND CONDITIONS APPLICABLE TO THE SERVICES;

B.  ACKNOWLEDGES THE PERSONAL DATA PROCESSING CONDITIONS ACCORDING TO THE CONFIDENTIALITY POLICY, WHICH IS INTEGRATED IN THIS SET OF TERMS AND CONDITIONS.

In order to ensure compliance with the terms of access and use of the Services, Users must check the terms and conditions of use at the time of each access to the Site and / or the eJobs Application.

Even if you omit to review the terms and conditions, but use eJobs.ro or the eJobs Application, we shall assume that you have accepted this set of Terms and Conditions (including any updates to them).

If you disagree with the provisions in this set of Terms and Conditions (including any updates to it), please do not use or, as the case may be, stop using the Site, the eJobs Application or the Services Offered by Us, as applicable.

2.  eJobs Services

eJobs.ro Services and the eJobs Application (eJobs Platform) are addressed to (i) Users, individuals who visit the eJobs Platform, (ii) Users who are seeking a job ("Candidate Users") and (iii) Users, legal entities or authorized individuals who post jobs or search for Candidate Users for certain jobs ("Recruitment Users").

eJobs Services also includes the www.wearehr.ro and www.brandyourhr.ro sites.

2.1.  User account creation, passwords, and responsibilities

Candidate Users may use certain eJobs Platform features without having a User account.

In order to benefit from all eJobs Services, Users (either Candidate Users or Recruitment Users) must create an eJobs Platform account by filling in the forms available in the "NEW ACCOUNT" section.

In the case of Candidate Users, User Account creation can also be made through the user account on the Facebook social media platform, in which case eJobs platform retrieves certain public data of the User related to his or her Facebook account.

Upon completion of the user account creation process, the User receives the required code for verification and validation of the contact data on the provided email address or on the telephone number provided in the sign-up process.

In order to use the Services offered by the eJobs Platform, it is necessary to:

a.  provide true, accurate, and complete data about you by filling in the fields in the Registration Form for User Account Creation;

b.  update the registration data to be true, accurate, and complete at all times when the situation so requires. Understand this update within 30 days of the date the changes occurred.

In the case of Recruitment Users, eJobs checks the correctness of the tax code registered on the Ministry of Finance website, www.mfinante.ro. For legal entities, Recruitment Users have the obligation to provide us with real information about the name, address, e-mail, telephone, name and surname of the contact person and fiscal code. The legal entities - the Recruitment Users with active account on eJobs have to be fiscal active (so, the companies of the Recruitment Users cannot be deleted from the Trade Registry, suspended or liquidated). This criteria does not apply to the companies in insolvency.

Companies recruiting for foreign companies are required to send the Registration Certificate issued by the Trade Register with the field of activity for the placement and recruitment of personnel.

Users who are based abroad must, at the time of registration on the site, fill in the valid VAT number in the dedicated field in the user account form and send us a copy of the document attesting the registration in the state of residence.

Through the survey, eJobs consultants may request documents about the Company's domain of activity if the contact person is empowered to represent the Company or verify the correctness of the telephone number indicated in the User Account Form.

If you provide non-conforming, inaccurate or incomplete information, eJobs has the right to suspend or block your account and refuse all current or future attempts to use the eJobs Platform. In case of innacurate information or of fraud attempts from the Recruitment Users (inclusive for obtaining free ads from eJobs), eJobs has the right, at any moment of the contractual relathionship, to remove the offered free ads or to terminate the contractual relationship, without any liability to the Recruitment Users in default.

eJobs is NOT required to check in advance the material published by Users. eJobs does not respond in any way to the information and data posted, disseminated or transmitted by its Users. If requested by a User, eJobs may investigate and verify the allegations and decide whether the information should be removed.

2.2.  Candidate Users

Candidate Users can only create a User account if they are at least 16 years of age at the time of creation. Access to the eJobs Platform and use of the Services is not permitted for persons under 16 years of age.

eJobs is an online recruitment platform that gives you the opportunity to create a CV or register a CV, including cover letters, in our database.

Also, as part of the Services offered, if you ask us, we can assist you through our consultants for writing and publishing a CV in your User account. With your consent, one of our consultants shall be able to process and post to your User account the CV you need. You can then edit the information so published.

CVs uploaded in eJobs platform and your contact details can then be made available to Company Users for recruitment. In this regard, Candidate Users have three options:

a.  You can register your CV in our database and you can chose not to make it public to Recruitment Users - when registering your account, the data in your CV are automatically set as public, you can subsequently make them confidential. By setting your CV as confidential, you can apply for jobs, but your CV can only be viewed by Recruitment Users who purchased your CV when it was still public, by Recruitment Users to whose ads you have applied in the past and by the Recruitment Users to which you shall apply in the future.

b.  You can make public your CV on eJobs platform - in this case Recruitment Users who have access to the database of eJobs Platform shall have access to your CV. If they want, they may require the unlocking of your contact data and you could be contacted. In order to be able to make your CV public, you can use the 'Public CV' option, available under 'Account Settings - CV Privacy'. You can change this option at any time and make your CV confidential by using the 'Hidden CV' option, available in the 'Account Settings - CV Privacy' section.

c.  You can make your CV public on the internet through Google.com, search.yahoo and other such search networks and services - your CV shall be available to these search engines as well as to other online search environments or search sources. However, your contact information (name, email, phone, address) shall not be available on these search engines. For access to these data, people who access your CV on Internet search engines must still create a User account in the eJobs Platform. For this, you can use the 'Online CV' option, available under 'Account Settings - CV Privacy'

We try to limit access to our database only to employers, human resources companies, HR managers, HR specialists, but we do not guarantee that other third parties cannot access our database. eJobs does not assume responsibility for the use of CVs by third parties who have accessed CVs while they are in our database.

You can deactivate your CV from our database at any time or, if you wish, delete your User account. If you disable your CV from the database or delete your user account, recruiters shall no longer have access to your data.

However, as part of the Services provided by the eJobs Platform, Recruitment Users who have accessed the CV access facility can download or transmit the information available on the eJobs Platform on their own storage media. In this case, even if we delete your data from our database, Recruitment Users shall still be able to access your data if they have downloaded, copied or extracted them from the eJobs Platform database. In their capacity of Operators, Recruitment Users are independently responsible for the way they use your data accessed through the eJobs Platform.

Certain companies that have chosen to post their recruitment ads via the eJobs Platform may understand that it is simpler to present a misleading, incomplete, incorrect or aggressive reality oriented towards other social categories. The present rules impose fairness on the part of employers, but not all Recruitment Users understand the rules. Therefore, you should discern before using the information contained in these ads, before going to an interview, before getting hired or making an investment or any other action involving the use of funds, your own resources or those of third parties. Please contact us if you are aware of the existence of such ads.

2.3.  Recruitment Users

eJobs provides you with password-based access to the User Account created on the eJobs Platform. Through eJobs, Recruiters can search for and select Candidate Users for hiring.

2.3.1.  How to publish recruitment ads on the eJobs Platform

Ads can be displayed on the eJobs Platform for a minimum of 30 days. Choose one of the price packages that corresponds to the number of days you want the eJobs recruitment ad to be visible. On the same day, your job is emailed to all Candidate Users who match the job profile and who are subscribed to such notifications. The job profile in the ad validated for publishing (The Recruitment User has clicked the publish ad button) can no longer be modified after the ad has been displayed on the eJobs Platform and/or has been sent to the Candidate Users. Job ads on eJobs can be published for a maximum of 5 cities and can include, as a request, a maximum of 2 foreign languages.

2.3.2.  "Free Ads" Policy for Newly Recruitment Users

eJobs can offer, free of charge, free credits for the publication of employment announcements on the eJobs Platform, with the offer being available only to Recruitment Users registered for the first time on the eJobs Platform, which complete the registration data correctly and completely, provided there are no suspicions of fraud in the system. Foe example, the free add type "Business" (valid for 30 days) is received only for the first registration of a company/group of companies/contact person, and not for further registrations of related accounts, eJobs reserving the right to refuse granting such a free credit, in case of indentifying an identity with a company already receiving such a credit.

Following the internal review of the Recruitment Users newly registered on the eJobs Platform, we reserve the right to refuse to grant free credits.

Free ads can have the same validity over time as paid ads and can only be published on behalf of the Recruitment User registered with the eJobs Platform.

We also reserve the right to refuse to publish or otherwise censor ads that are contrary to law or morality, or that contain foul language. For example, we shall not accept video chat, erotic massage or similar ads.

In this sense, you accept and agree that you shall observe the rule of good faith when designing and publishing the recruitment notice. Thus, you are obligated not to publish incomplete, incorrect, or discriminatory advertisements, and not to make subsequent selection of Candidate Users conditional unless upon the rules outlined in the recruitment notice published in compliance with the relevant applicable law.

In the event you do not comply with these rules, you understand and agree that eJobs has the right to restrict your access to its Services. In the case of restricting access to Recruitment Users who have accessed Paid Services, they shall be entitled to request a partial refund of the fee for the restricted period.

2.3.3.  Choose to search for CVs of Candidate Users available in the eJobs Platform

Choose one of the price packages that correspond to the number of CVs you can view in the eJobs Platform database. Pay the Service price. You can search through all the public CVs in the database. You can view as many CVs without contact details. Depending on your chosen Services Package, you can view the contact details of a certain number of CVs.

In all cases, you understand and agree that you shall not use the data contained in the Candidate User's CVs except for the sole purpose of recruiting staff for the company that published the recruitment notice.

Certain candidates who have chosen to enter their CVs in the eJobs Platform database may understand that it is simpler to present a misleading, incomplete, incorrect or aggressive reality to other social categories. Therefore, you should discern before using the information contained in these CVs, before hiring, making an investment or any other action involving the use of funds or own resources or those of third parties. Please contact us if you are aware of the existence of such CVs.

2.3.4.  Subscriptions, payment of subscriptions, and other transactions

Access to certain Services provided to Recruitment Users may only be allowed after a subscription has been paid. All payments, including the fees applicable to these payments, shall be made on the basis of the pro forma invoice or, upon your request, based on the tax invoice in the account indicated by eJobs at the NBR exchange rate from the date of the pro forma issuance. Access to some of the Services is only allowed after the payment in eJobs account is confirmed.

The eJobs Platform can be used by some of its business partners as the basis for selling or promoting products and services. In this situation, the contract that governs your agreement between you and the supplier of the respective products and services shall be concluded between you and that supplier of products and services and not between you and eJobs.

If you wish to terminate the delivery of services, you understand and agree that payments already made are not and shall not be refunded.

The services provided by eJobs are based on a certain number of public announcements or CVs with contact data. eJobs may change the price set for service provision, as may amend any other clause of this agreement upon termination of the initial contract period.

You accept and you agree that the purchased services will be used within a maximum of 24 months from the date of the invoice. Unused services (credits) are no longer valid and will be deleted from the Recruiter's user account after 24 months from the date of the invoice.

You acknowledge and agree that any delay in the payment to eJobs constitutes a violation of the provisions of this Agreement. In the circumstances in which eJobs reserves its right to adopt any other attitudes permitted by the law or the contract, you agree to and understand to REIMBURSE TO EJOBS ALL COSTS AND EXPENSES RESULTING IN CONNECTION TO THE RECOVERY OR ATTEMPT TO RECOVER SUCH OUTSTANDING AMOUNTS.

You acknowledge and agree that posting an ad on eJobs before making a payment to eJobs is equivalent to entering into a contractual relationship with eJobs, giving rise to the equivalent obligation to pay for that ad.

Upon expiration of the agreed time limit for payment of a pro forma invoice as specified on that invoice, eJobs is entitled to restrict access until the payment is made. Failure to pay may result in the calculation of late payment penalties of 0.1% per day of delay, calculated up to the payment of the full amount.

The above has no repercussions on ads that shall remain active: Candidates shall still be able to apply to the company's active ads, and you shall have access to their CVs after making the payment.

2.3.5.  Accessing the Recruitment User account for other people within the same organization

The Recruitment User account also allows other people (e.g., employees, collaborators) to access the notifications sent by the Company to the Recruitment User account. The Recruitment User is responsible for collecting the personal data of the persons concerned, in particular informing and obtaining consent (or identifying another legitimate basis) for the transmission to the Company of the personal data used for the transmission of such communications.

2.4.  Publication of CVs / recruitment announcements through the eJobs Platform

The eJobs Platform is a communication platform between Users, who are responsible for the content posted in the eJobs Platform (CVs, Recruitment Ads, etc.), hereinafter referred to as "User-Submitted Content." We reserve the right (which can be exercised at any time and without previous notice) to remove, move or edit these messages, or to restrict the access of some users to one of their communication platforms. These measures may be taken as a result of non-compliance by Users with the legal provisions or the terms and conditions of use of the eJobs Platform.

The user is solely responsible for the Content posted by that User. In this regard, you must be aware that posting or transmission of messages through the eJobs Platform is subject to the following conditions and limitations:

a.  Published ads must be complete, containing all the information or conditions associated with the ad. On add can be published just for one job.

b.  You may NOT publish, transmit or refer to any message that may contain a form that is unanimously recognized by the Company as being "advertisement" to various categories of goods and services.

c.  You may NOT post, transmit or recommend to Users any unsolicited commercial message, whether or not this is done through the communications systems provided by eJobs or other means of communication but using the data obtained through the eJobs Platform.

d.  You may NOT publish, transmit or refer in any way to messages containing recommendations to buy or not to buy a particular product or service. You may also not post or refer in any way to messages containing confidential information, whether or not they are referred to as "confidential" or any other such statement, or to messages that are intended to affect the price, the image or the market value of a product or service. You may NOT publish employment adds inside networks as AVON, ORIFLAME or other the same, as well as the employment adds for banking collaborators.

e.  You may NOT publish, transmit or refer in any way to messages containing illegal, threatening, abusive, indecent, discriminatory, or in any way violating third party rights or legal provisions.

f.  You may NOT publish, transmit or refer in any way to messages containing viruses or any other code sequence that proves to be destructive or that may interrupt, eliminate or limit the functionality of the eJobs Platform or any other computer system (hardware or software).

g.  You may NOT collect any personally identifiable information from users or eJobs members except for the sole and direct purpose of accessing the Services provided by eJobs (i.e. applying to a Recruitment User's job or contacting Recruitment Candidates).

h.  You may NOT restrict or remove the access of other Users to the communication platforms provided by eJobs.

i.  You may NOT publish, transmit or refer in any way to messages whose source is hidden.

j.  You may NOT publish, transmit or refer to any kind of "pyramidal game" or any other activity intended to mislead the trust of persons as well as any similar activities in respect of which the criminal potential or the potential to deceive the trust of a User of eJobs Services has been proven in the past.

k.  You may not publish any material that contravenes any other provision of this Terms and Conditions, eJobs may discretionally remove them from the eJobs Platform without any explanation in this regard.

By publishing Content Posted by the User on or through eJobs Platform you agree that you are solely responsible and shall indemnify eJobs for any damage, costs or limitations profits arising from the posting, transmission or by reference to your messages the content of which violates the conditions and limitations described above.

Some Users may understand that it is simpler to violate the rules foreseen in this set of Terms and Conditions, and as a result, some of the published messages may present a misleading, incomplete, incorrect, or aggressive reality to other social categories. You should therefore discern before using the information contained in these messages to make an investment or any other action involving the use of funds or own resources or of those of other third parties. The picture presented by published messages can sometimes be different from reality.

3.  User Account Protection (Candidate User or Recruitment User)

Your access to the User Account of the eJobs Platform is protected by a password. We recommend that you do not disclose this password to anyone. eJobs shall never ask for your account password in unsolicited messages or telephone calls. Furthermore, we recommend that you exit (i.e.log off/sign out) at the end of each session. We also recommend that you close the browser window you were working in at the end of browsing eJobs. If you use the eJobs application, we recommend that you take additional protection measures to prevent unauthorized access to the mobile devices you use to access the eJobs Application (e.g. mobile device password).

These tips are intended to remove unauthorized people from accessing your personal information or your mail.

You are responsible for keeping the confidentiality of your information and password. You shall be responsible for the use of your registration, whether or not the use is done with our without your approval. You agree to inform eJobs of any unauthorized use of your registration data in the eJobs Platform. The Company shall not be liable for any moral or material damage caused by your failure to comply with the data security measures used to access the eJobs Platform.

4.  Protection of intellectual property

The content and design of the eJobs Platform (as well as any other eJobs-related material) sent to you by email or provided to you in any other way (such as articles, design, and any other material we refer to "eJobs Content") belong to eJobs and its collaborators - where this is expressly specified or another author is not specified - (copyright) and are protected by intellectual property law. Articles published in the sections with articles (e.g. "Career", "We are HR", etc.) may not be made by eJobs, in this case the intellectual property rights belonging exclusively to the eJobs collaborators who have realized them.

You may not use, reproduce, or permit anyone to use or reproduce the materials without the written permission of eJobs or its collaborators who own an intellectual property right over the eJobs Platform's content section. It is also forbidden to reproduce in any way, in whole or in part, the information contained in Candidates' CVs, in Company recruitment notices without the prior written consent of eJobs.

You may only use the content of the eJobs Platform for your and your company's use within the purpose for which you have registered in the eJobs Platform. Except as stated above, the content of the eJobs Platform may not be reproduced, modified, and exploited, regardless of the commercial or non-commercial purpose of that exploitation.

Actions of the kind described below are not allowed unless prior written permission is received from eJobs:

a.  reproducing or storing the content, as well as sending this content to any other site, server or any other means of storing the information.

b.  modification, publication, transmission, and participation in the transfer, sale, distribution of materials made by reproducing, modifying or displaying the content, unless prior written permission is obtained from us.

c.  removing the marks that signify the copyright of eJobs on the content.

Any use of the contents of the eJobs Platform for purposes other than those expressly permitted by this document is forbidden. Applications for use of the content for purposes other than those expressly permitted by this document may be sent to the following email address: contact@ejobsgroup.ro.

It is also prohibited to use any automated means, including scripts, robot applications, bot, spider, crawler and / or any computer applications / programs that can mislead or simulate certain activities or statuses in the eJobs Platform or, in any way exploits certain features or vulnerabilities of the eJobs Platform in order to obtain advantages for itself or for other Users or third parties regarding the use of the eJobs Platform or the access and use of any Services.

5.  Protection of personal data

The Company treats seriously the privacy of the User's personal data. The Privacy Policy and aspects of how the Company processes the personal data of Users (including representatives of Recruitment Users) are described in the Privacy Policy

It should also be noted that Recruitment Users act as personal data providers under the applicable law and as such they have a series of rights and obligations related to the personal data of Candidate Users accessed through the eJobs Platform.

WHEN USING THE SERVICES PROVIDED THROUGH THE EJOBS PLATFORM, RECRUITMENT USERS ACCEPT AND AGREE TO COMPLY WITH THE TERMS AND CONDITIONS SET OUT IN THE PERSONAL DATA PROCESSING AGREEMENT WHICH IS A INTEGRATING PART OF THE PRESENT TERMS AND CONDITIONS. WHEN CREATING A RECRUITMENT USER ACCOUNT, THE TERMS AND CONDITIONS SHALL INCLUDE THE ANNEX AND THE AGREEMENT ON THE PROCESSING OF PERSONAL DATA, WHICH ARE AVAILABLE IN YOUR USER ACCOUNT.

Also, in the case of Recruitment User located in third countries who have not been granted an adequate level of protection, they shall be able to access Candidate User personal data only on the basis of a set of standard contractual clauses on the introduction of an alternative set of standard contractual clauses for the transfer of personal data to third countries approved by the EU Commission. The Personal Data Processing Agreement also includes a set of standard contract terms that must be accepted by such Recruitment User before being granted access to Candidate User data.

In the absence of Standard Contractual Clauses signed with the Recruitment User, the transfer can only be made under other mechanisms that secure appropriate safeguards under Article 46 of the GDPR or if the transfer is required to execute a contract with the person concerned (i.e. when the Candidate User applies directly to a job advert published by a Recruitment User located in a third country).

6.  Changes and Suspension of Access

eJobs reserves the right to suspend, modify, add or delete portions of the eJobs Platform content at any time. Also, eJobs reserves the right to restrict user access to part or all of its content.

eJobs may, without any other notice or formality and without needing to explain its attitude, suspend or terminate your access to the content of the eJobs Platform or any part of it. In this regard, eJobs may block access to, use of, or use of any of its other services, or remove and delete any material from the Services for any reason whatsoever. eJobs may also, whenever it wishes and without providing justification, interrupt the provision of the Services, or part thereof, with or without prior notice.

In this case, the provisions of Section 2.3.4 of the Terms and Conditions shall apply, where applicable. In the case of restricting access to paid service users, they understand and agree that the only claims they can make against eJobs are limited to requesting a refund of the part of the fee for the restricted period.

7.  Lack of warranty and disclaimer

While at all times it strives to ensure the quality and fairness of the data published in the eJobs Platform, eJobs cannot guarantee in terms of its content, the correctness, completeness and actuality of the information presented in the Candidate User's CVs and the recruitment announcements posted by the Recruitment Users, software or products and services published under the aegis of the eJobs Platform. To the extent that the applicable law permits, eJobs shall not be held in any way liable for any damages directly or indirectly caused by any direct or indirect loss of (including, but not limited to: damages for loss of profits, interruption of business, or other pecuniary damage), suffered as a result of the use or interruption of the use or lack of regularity of the information and Services provided by eJobs.

eJobs does not guarantee the accuracy, correctness or actuality of the information or Services provided by eJobs. Also, eJobs does not guarantee that computer systems or programs used by eJobs to display or transmit information on the eJobs Platform or in any other form do not contain viruses or other destructive code sequences or other destructive properties.

To the extent that the applicable law permits, you agree to release eJobs from liability for any court or out-of-court actions and to cover the costs and other expenses that may arise as a result of your breach of the terms of this set of Terms and conditions.

8.  Major Force

eJobs, its affiliates or, in general, information providers to eJobs cannot be held responsible for any delay or error in the content provided by our publications, resulting directly or indirectly from causes not dependent on the shall of eJobs. This exemption includes, but is not limited to: errors in the eJobs technical equipment, lack of Internet connection, lack of telephone connections, computer viruses, unauthorized access to eJobs, operating errors, strike, etc.

9.  Miscellaneous

9.1.  Changing the terms of this agreement

THE COMPANY RESERVES ITS RIGHT TO PERIODICALLY UPDATE THIS SET OF TERMS AND CONDITIONS (e.g. TO CORRESPOND WITH THE CHANGES IN LEGISLATION OR SERVICES PROVIDED BY THE COMPANY). USERS SHALL BE NOTIFIED WITH REGARD TO THE OPERATION OF UPDATES / CHANGES IN THE SET OF TERMS AND CONDITIONS AND REQUIRED TO EXPRESS AGREEMENT WITH THE UPDATED SET OF TERMS AND CONDITIONS. REFUSAL TO ACCEPT the UPDATED set of Terms and Conditions SHALL BRING ABOUT THE TERMINATION OF THE CONTRACT WITH THE COMPANY, AND USERS SHALL NOT BE ABLE TO USE THE EJOBS PLATFORM AND / OR THE SERVICES OF THE COMPANY.

Also, some services offered by eJobs may be subject to different terms, which shall be displayed for each such service in a visible place and can be accessed prior to using the service.

9.2.  Advertising and content provided by other parties

Parts of the content included in eJobs may be provided by third parties with whom eJobs has concluded content delivery contracts. In addition, eJobs content may include ad slots where third-party ad messages shall be displayed. eJobs is not responsible in any way for the content provided by third parties, whether it is advertising or not. Also, eJobs is not responsible for the content of pages referenced from within.

9.3.  Notifications

Any notification to eJobs must be sent in writing, by e-mail, by post or fax.

Unless the User communicates any change, the notifications shall be sent to the contact data provided by the User, and the respective notifications shall be deemed received by the User.

9.4.  Applicable law and jurisdiction

The rights and obligations of the parties under this Agreement, as well as all the legal effects of this Agreement, shall be construed and governed by the applicable Romanian law. Any dispute relating to this agreement shall be settled before the competent courts in the location of eJobs.

DATA CONFIDENTIALITY POLICY

The Company processes a series of personal data of Users, Candidate Users or Recruitment Users (i.e. representatives of Recruitment Users, Legal Entities, or Authorized Individual Recruiters) when using eJobs.ro, eJobs, or eJobs Services.

This Privacy Policy (the "Policy") describes what types of personal data are processed, how they are used, what your options are in connection with these processing operations, and how We shall respect your rights in accordance with (EU) legislation 2016/679 ("GDPR"), as person subject to the data protection legislation.

BEFORE USING EJOBS.RO, EJOBS APPLICATION OR OUR SERVICES, WE RECOMMEND THAT YOU READ THIS POLICY TO UNDERSTAND HOW PERSONAL DATA IS PROCESSED.

1.  Who is responsible for processing your data?

eJobs Group SRL, based in Dimitrie Pompeiu Blvd., No. 9-9A, Sector 2, Bucharest, Romania, is the operator of personal data under personal data protection law, including the GDPR, as regards to the personal data of the Users collected and processed through eJobs.ro and the eJobs Application.

For the processing of personal data, the Company has appointed a Data Protection Officer or DPO that can be contacted using the following contact details:

As for data collected through cookies for marketing purposes (for details, see the Cookies Policy section), the Company, as a member of the Ringier Group companies, cooperates with Ringier Romania SRL to manage how advertising cookies are used. In relation to these types of processing, the Company acts as an operator associated with Ringier Romania in accordance with art. 26 of the GDPR. Both the Company and Ringier Romania have undertaken to comply with the legislation on the protection of personal data in connection with this processing.

2.  What data do we process?

We process the following categories of personal data:

Data you provide directly

Creating the User Account

When you create a User account, you must provide us with a series of data such as your first name, surname, e-mail address / mobile phone no., age, position held within the company (in the case of the Recruitment User account), etc.

Data from the registered user profile

You can include a number of information in your user profile as well as in the CVs that are part of your Candidate User account such as your studies, professional experience, skills, photos, job preferences, information etc.

Other data you provide directly when using the eJobs Platform or interacting with eJobs

We can store the information you received from us as a result of requests sent by email or chat, or when you participate in our polls and questionnaires; Also, if you use our remote interview services, we can process your image and voice through online conferencing services implemented in the eJobs Platform, and we can have access to your eJobs service conversations through our Call Center service.

Data collected or generated by us as a result of your interaction with the eJobs Platform

We receive information about when and/or how you visit or otherwise use eJobs Services, including how you use the eJobs Platform (e.g., whether you've updated your CV or not, whether or not you applied to a job).

We also use cookies and similar technologies to recognize you and your devices. We also allow others to use cookies. The way we use these technologies is described in the Cookies Policy.

Also, when using the eJobs Platform (including cookies or similar technologies on other sites), we receive information about your IP address, IP-based location, proxy server, operating system, web browser and add-on modules, device identifier. If you use our services from a mobile device, that device sends us data about your location based on your mobile device settings. We shall ask you to accept prior to using GPS or other tools to identify your location.

Data obtained from third parties

We receive information about your visits and interaction with services provided by other entities when you visit the services of other providers including advertisements, cookies, or similar technologies.

In the case of contact persons designated by recruiters (other than account holders), the data is collected from that account holder.

3.  Why do we process your personal data?

In what follows we shall inform you of the purposes for which we collect and process your personal data and on the legal basis for data processing.

3.1.  Use of Services by Candidate Users

If you want to enjoy all the facilities offered by the eJobs Platform, you must create a User account. The User Account allows you to access a range of dedicated Candidate Services such as creating a CV, applying to a job, viewing employment ads, contacting recruiters, receiving ads and alerts related to ads recruitment published by Recruitment Users, etc. Legal basis: Art. 6 (1) (b) GDPR - conclusion and performance of the contract.

The eJobs Platform can also be accessed by Recruiters Users abroad, including outside the European Economic Area, to jurisdictions that have not been adequately protected. If you apply for a position published by such Recruitment Users, your data may be transferred to such jurisdiction, and the legal basis for the transfer is Art. 6 (1) (b) GDPR - conclusion and performance of the contract.

We process your personal data contained in your CV, i.e. your professional experience, in order to display recommendations of Recruiters and jobs on eJobs platform. The services offered by eJobs in the form of recommendations on the platform facilitate your job search and application process. Legal basis: art. 6(1)(f) GDPR - legitimate interest.

We can also use a range of data you provide to optimize your job recommendations or suggestions to complete your CV. We also use the data we receive from Candidate Users to create Filter Facilities for Candidate Users on various criteria of interest to Recruitment Users. Legal basis: Art. 6 (1) (f) GDPR - legitimate interest. We have a legitimate interest in improving our Services and providing suggestions / tips to Candidate Users to maximize the success of our Services. At the same time, we want to provide a search service for indicators as efficiently as possible for Recruitment Users.

3.2.  Use of Services by Recruitment Users

We process personal data for the purpose of managing a contractual or pre-contractual relationship with Recruitment Users. In the case of Recruitment Users (authorized natural persons) the legal basis is: art. 6 (1) (b) GDPR - conclusion and performance of the contract or execution of pre-contractual formalities. In the case of personal data of representatives of Recruitment Users, the legal basis is Art. 6 (1) (f) GDPR - legitimate interest. We have a legitimate interest in properly conducting our contractual relationships with our corporate clients. The rights and interests of individuals (i.e. representatives of Recruitment Users) are not prejudiced since, from the perspective of the client, processing is necessary in the context of developing the work / collaboration relationships they have with the individuals whose data is provided / associated with the Recruitment User account.

Also, based on legitimate interest, we use certain personal data associated with a Recruitment User account to prevent any abusive fraud / misuse of the eJobs Recruiting Platform facilities.

3.3.  Managing relationships with Users and support

We process a series of personal data for the purposes of managing relationships with eJobs Platform Users, for example when contacting us with various questions or requests about eJobs Platform functionality, eJobs Platform malfunctions or errors. Legal basis: Art. 6 (1) (f) GDPR - legitimate interest in our interest in providing appropriate services to all Users.

3.4.  Providing communications on the Services

Users may receive various communications from Us that relate to the provision of the Services (e.g. if the CV was viewed by a Recruitment User, the Recruitment User has viewed the CV, saved the jobs that are expiring, alerts on the need to update the CV, alerts on scheduled interviews, etc.). We process these data based on our legitimate interest in art. 6 (1) (f) GDPR. We consider that our legitimate interest is to not prejudice the rights and interests of the data subjects as communications are closely linked to the provision of the Services requested. At the same time, we offer users the ability to disable these communications at any time from their User account settings.

Providing commercial communications

We want to send you promotional materials, let you know about the new services offered by the Company, launch invitations to participate in polls or to answer questionnaires and to communicate other similar information that we consider to be of interest to you, including, if you agree, by sending you promotional materials / marketing communications on the products / services of our Company’ partners.

We shall forward these communications if we have your agreement. Legal basis: Art. 6 (1) (a) GDPR - Consent.

Users can always unsubscribe from these communications. For example, if you withdraw your consent for commercial communications, we shall not be able to send you our offers or you shall not be able to participate in our polls and surveys.

Also, if we have the consent for commercial communications, in certain circumstances, we may use the information collected from you in combination with the data resulting from your interaction with the eJobs Platform Services, to be used in the context of our marketing communications. The legal basis for such processing is: art. 6 (1) (f) GDPR - legitimate interest. We want to streamline our marketing activity by offering our customers relevant and personalized service offerings.

3.5.  Using geolocation services

When using the mobile device geolocation feature, we shall ask for your consent. Legal basis of processing: Art. 6 (1) (f) GDPR - Consent.

3.6.  Analyses and statistics on the eJobs Platform, cookies, and similar technologies

We may use the personal data that the Users provide or that we collect in the context of using the Services for the purpose of performing analyses and statistics on our Services, including how the eJobs Platform works. The legal basis for such processing is: art. 6 (1) (f) GDPR - legitimate interest. The analyses and statistics we make help us to better understand how we can improve our Services or the eJobs Platform functionality.

We also use cookies and other similar technologies under the Cookies Policy to conduct analyses and statistics. Depending on the type of cookies used and similar technologies, the legal basis is: art. 6 (1) (f) GDPR - legitimate interest in necessary and functional cookies or art. 6 (1) (a) GDPR - Consent for analysis, tracking, and behavioural advertising cookies.

3.7.  Connecting via Facebook plugin

Candidates can sign in or create an account using the Facebook plug-in that allows you to sign in with your Facebook account. When Candidate Users use this feature, public data (e.g. name, surname, email address, telephone number ). Use of this data is necessary for the creation of the User account, therefore the legal basis of the processing is Art. 6 (1) (b) of GDPR, respectively the conclusion and performance of the contract.

3.8.  Fulfilment of legal obligations

Sometimes data processing is required to meet our legal obligations (Legal basis: Article 6 (1) (c) GDPR - Enforcement of a legal obligation), such as:

  •  payment of taxes and relevant contributions, reporting to relevant tax authorities and keeping accounting records;

  •  archiving data according to applicable law.

3.9.  Defence of rights and interests in justice

We may also process personal data for the purposes of establishing, exercising or defending a legal remedy in proceedings before a court, administrative procedure or other formal proceedings in which the Company is involved (Legal basis: Article 6 (1) (f) GDPR - protection of the rights and interests of the operator)

4.  Who do we reveal the data to?

We may disclose your personal data to (i) Entities and / or persons empowered by us (from EEA or third-party states) involved in the provision of Services, including the provision of commercial communications (such as data centre providers, payment for various payment facilities in the eJobs Platform, e-mail platform providers such as Google Mail); (ii) Recruitment Users including, where applicable, those located outside the EEA; (iii) if we are required to disclose personal data for compliance with any legal obligation or decision of a judicial authority, public authority or governmental authority; or (iv) if we are required or otherwise permitted to do so under applicable law. Your personal data may also be disclosed to third-party cookies providers and similar technologies as described in [Cookies Policy – link to be inserted].

5.  How do we keep the data?

We keep your personal data as necessary to meet the purposes for which it was collected, with due regard for internal data retention procedures, including applicable archiving rules.

In general, Candidate User Data is retained as long as it has a User Account in the eJobs Platform. Personal data shall be deleted if the Candidate User requests to deactivate and delete the account, or after a minimum of 5 years from the date when the Candidate User becomes inactive (i.e. from the date of the last interaction in the eJobs Platform).

The data of Recruitment Users (authorized natural persons and legal entities) shall be retained for the entire duration of the contractual relationship with the Recruitment Users plus for the entire period stipulated by law for the archiving and safekeeping of financial-accounting documents.

Data for cookies and similar technologies are kept according to the specific terms set for those technologies, the storage period being between the duration of the session (for session cookies) and a duration of up to 2 years (for analysis cookies).

6.  What rights do you have as a person of interest?

By law, the following rights of the person of interest are recognized:

a.  Right of access

you can obtain from us the confirmation that we process your personal data as well as information on the specifics of the processing

b.  The right to correct the data

you can ask us to modify your incorrect personal data or, if necessary, fill in the data that is incomplete.

2.4.2.  Third-party advertising

Most of the ads you see on the Site are run by eJobs and / or by Ringier Romania. However, we also allow other companies to provide advertising material and collect information through cookies or other similar technologies (third parties) included in the Site.
